The Idaho Code does not give the death penalty.  The Idaho Code merely
identifies penalties which may be imposed against somebody convicted of
various offenses committed against the state.

A jury recommends punishments and the judge, applying whatever variables
(s)he applies, imposes punishments.

Perhaps, though, you should "look directly at Idaho Code to confirm it".
