The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations may be placed on the time allowed for comments.  Citizens wishing to comment on business that is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" in the door pocket outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings.

C.     Fiber Lease Agreement - Jesse Flowers

Staff has been approached by First Step Internet with a request to lease fiber optic strands from the City from City Hall to the Latah County Courthouse.  Staff has prepared a draft lease agreement in accordance with the Fiber Use Policy that was adopted by the City Council on December 18th 2006.  The lease agreement would be for a term of 3 years and would include 1 strand along a distance of 1,615 feet for total leased strand footage of 1,615 feet.  Reviewed by the Public Works/Finance Committee on July 13, 2009.

 

            ACTION:  Approve the Lease Agreement.

 

D.     1521 W. A Street Lot Division - Mike Ray

Gary and Lynne Young are requesting a lot division for an approximately 2.45 acre parcel currently addressed as 1521 West A Street and located at the corner of Farm Road and A Street in the City of Moscow. The applicants are requesting to divide the parcel into two separate lots, the western being 2.01 acres and the eastern being 0.44 acres as shown on the attached map. The proposed lots are in the Motor Business (MB) Zone which has no minimum lot size or minimum lot width requirements for commercial uses. In accordance with City of Moscow requirements, property owners within 600 ft of the property have been notified of the proposed division and the site has been posted seven (7) days prior to the meeting date.  Reviewed by the Public Works/Finance Committee on July 13, 2009.

 

            ACTION:  Approve the lot division.

 

E.      Approval to Submit ARRA Grant Application to ICA - Alisa Stone/Kathleen Burns

ICA has announced a grant opportunity under the American Recovery and Reinvestment Act (ARRA) to fund arts organizations that have had or will have staffing cut backs or have had to cancel events due to the downturn in the economy.  The "Young Peoples Art Festival" (YPAF) has been cut from the list of activities the Moscow Art Department was offering to the youth of our community.  Not only are the youth losing an important program but the artists that are paid by the City to teach the classes will have income loss.  The Arts Department is preparing a grant request to ICA requesting $3,000 in order to offer the YPAF in the fall of 2009.  Matching funds are not required under this program.  Reviewed by the Administrative Committee on July 13, 2009.

 

ACTION:  Approve submittal of a grant application to the ICA to fund the Young Peoples Art Festival.

 

F.      EPA Climate Showcase Grant Application - Alisa Stone/Heather Smith

The CSC grant program is providing funding for planning, demonstration, and/or implementation projects designed to address climate change by reducing GHG emissions.  The goal of the program is to implement programs, projects, and approaches, which demonstrate documentable reductions in greenhouse gases and are replicable elsewhere.  The City of Moscow will be the grant applicant and the fiscal agent and subawardees will be the University of Idaho (UI) through their Sustainability Department and the Bioregional Planning and Community Design Program; Palouse Clearwater Environmental Institute (PCEI), and Avista.  A 50% match is required and can be in the form of cash or as in-kind contributions, such as use of volunteers and/or donated time, equipment, expertise, and resources, etc.  It is anticipated the grant application request will be in the range of $450,000 to $500,000 for a three-year project.  The City's match will be in-kind resources provided through already established programs and services.  Each subawardee will also provide in-kind match for their program activities.  Reviewed by the Administrative Committee on July 13, 2009.

 

ACTION:  Approve submittal of a grant application to the EPA Climate Showcase grant program in collaboration with subawardee agencies.

 

2.      Mayor's Appointments - Mayor Chaney

 

3.      Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting. 

 

4.      Idaho Department of Parks and Recreation - Recreational Trails Program (RTP) Grant Award - Agreement Form - Roger Blanchard

The City of Moscow has been awarded a grant from the Idaho Department of Parks and Recreation in the amount of $76,352 which will fund 50% of the total project costs to pave the path system from Mountain View through the Carol Ryrie Brink Nature Park connecting south through Heron's Hideout back to Mountain View.  Also included in the project is the purchase of two small sections of property located near Heron's Hideout for path connection and accessibility.  The City is also providing a 50% cash and in-kind match of $76,352 ($60,022 cash for purchase of property and construction cost plus $16,330 in-kind engineering and miscellaneous services) toward the total project costs of $152,074.  This completed path connection will provide 2.34 miles of walking/biking systems from Mountain View near White Avenue to the north end of Mountain View Park.  

 

ACTION:  Approve execution of the Agreement Form accepting the award of a $76,352 from the Idaho Department of Parks and Recreation for Paradise Path improvements or take other action deemed appropriate.

 

5.      Draft Ordinance Banning Smoking in Bars - Randy Fife

Recently a request was made to City Council to produce an ordinance prohibiting smoking in bars within the City allowed by State Code Section 39-5511.  Attached is a first of an ordinance which defines the word "bar" and "private club" and prohibits smoking therein and within 20 feet of an entrance or exit.  It also provides for smoking in an open deck and/or in a designated indoor smoking area.  It also establishes an administrative remedy which allows a defendant to pay an administrative fine within fourteen (14) days of receipt of the notice of violation in exchange for a reduction in cost (for up to three [3] violations).  In the event the administrative fine is not paid within fourteen (14) days, MPD will issue a Uniform Citation and file it with the Magistrate's court.  A person found in violation of the ordinance will pay an infraction penalty of fifty dollars $50 for each conviction up to and including a third conviction.  A fourth conviction and above will result in a misdemeanor and a probable fine of $188, with no jail time.  Reviewed by the Sustainable Environment Commission on June 16, 2009.  Reviewed by the Administrative Committee on June 22 and July 13, 2009.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.

 

6.      Public Hearing - Ordinance to Open FY09 Budget - Don Palmer

The State of Idaho allows Cities to amend the original appropriation ordinance in accordance with Title 50-1002 of the Idaho Code.  Staff is proposing to amend Ordinance 2008-17 because of unallocated fund balance carryover due from authorized expenditures or unexpected and unallocated revenues.  All of the appropriation changes total $3,696,462.  Reviewed by the Public Works/Finance Committee on July 13, 2009.

7.      Downtown Parking

 

A.     Ordinance Regulating Downtown Overnight Parking - Les MacDonald/Randy Fife

On July 6, 2009, the City Council adopted part of the changes suggested by the Downtown Parking Implementation Committee relative to all-night parking.  Among other things, the Council determined that downtown parking should be prohibited from 3:00 a.m. to 6:00 a.m. except in specifically designated areas which will allow parking overnight.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.

 

B.     Ordinance Regulating Farmers' Market Parking - Les MacDonald/Randy Fife

On July 6, 2009, the City Council adopted part of the changes suggested by the Downtown Parking Implementation Committee relative to overnight parking.  Among other things, the Council determined that downtown parking should be prohibited from 3:00 a.m. to 6:00 a.m. except in specifically designated areas which will allow parking overnight.  Because of the change in parking prohibition from 3:00 a.m. to 6:00 a.m., the Farmers' Market overnight parking regulation should be changed to 3:00 a.m. to 2:00 p.m. every Saturday in the months of May through October annually in order to be consistent with the downtown parking changes made by Council.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.

 

C.     Resolution for Regulating Downtown Overnight Parking Map - Les MacDonald/Randy Fife

On July 6, 2009, the Council adopted a proposal made by the Downtown Parking Implementation Committee to prohibit parking in the designated downtown area except for certain specifically identified locations which will allow parking overnight.  The Resolution adopts a map which adopts those changes in the current downtown parking regulations.

 

ACTION:  Approve Resolution or take such other action deemed appropriate.

 

8.      Comprehensive Water System Plan Professional Services Contract - Les MacDonald

As part of the management of a public utility it is necessary to perform a periodic review of the existing system and an assessment of system needs to resolve existing issues and meet long term growth, rehabilitation, and capacity demands.  The State of Idaho has recognized the importance of such reviews and has joined most other States in requiring public water and sewer systems to prepare a System Facilities Plan which accomplishes these assessments.  A Comprehensive Water System Plan (CWSP) meets the requirements of the State for a System Facilities Plan by providing a review of the existing system, identification of system inadequacies, and detailing system improvements to resolve deficiencies and meet future growth needs.  Put simply, the CWSP is a management and business plan for the water utility covering policies, operations, water quality and supply, water rights, and system improvements.  It provides a detailed water utility work plan for the next 6 years, identifies long-term needs and opportunities, and outlines strategies for utility management for the next 50 years.  Public Works prepared a draft scope of work and a Request for Qualifications (RFQ) which was advertised. Eight Statements of Qualification (SOQ) were received and reviewed.  After an initial screening, three consultants were interviewed and the selection committee chose HDR to perform the study.  Reviewed by the Public Works/Finance Committee on July 13, 2009.

 

ACTION:  Approve the HDR Professional Services agreement for the development of the City of Moscow Comprehensive Water System Plan or take other action as may be deemed appropriate.

 

9.      Bus Shelter Bid Award - Gary J. Riedner

On July 8th, staff opened bids for this year's bus shelter project.  The project consists of installing City furnished bus shelters at the following five locations:  1. East side of Farm Road by Winco;  2. South side of 'E' Street west of Main Street;  3. 'F' Street and Mountain View Road intersection; southwest quadrant;   4. Sixth and Blaine Street intersection, northeast quadrant; and 5. West side of Blaine Street just south of White Avenue, by Wells Fargo Bank.  Construction includes: shelter assembly and installation; reinforced concrete support slabs; concrete pedestrian drop and concrete sidewalk modifications; and electrical work for lighting.  McCall's Classic Construction of Clarkston submitted the low bid in the amount of $47,075.25. Reviewed by the Public Works/Finance Committee on July 13, 2009.

 

ACTION:  Accept the low bid and awarding the contract to McCall's Classic Construction in the amount of $47,075.25.
