1.      Approval of Minutes January 26, 2009 - Stephanie Kalasz

 

2.      2008 Citizen Survey Results - Jen Pfiffner/Gary J. Riedner

The Administration Department administered the fourth comprehensive City of Moscow Citizen Survey in November of 2008.  The purpose of the survey was to assess the public's opinion of various aspects of City services and operations.  Additionally, questions were included by the City's citizen committees and commissions related to each of the group's charge and mission.  The surveys were mailed to 1,200 randomly selected residents.  A total of 356 completed surveys were received, which after accounting for non-deliverable surveys resulted in a 35% response rate.  Staff will present the final report and findings of the survey at the February 17, 2009 City Council meeting.

 

ACTION:  Receive report.

 

3.      Clarification of Proposed Vicious Animal Ordinance as a Misdemeanor - Randy Fife

Currently under Moscow City Code § 10-5-14, a citation for vicious animal is an infraction pursuant to M.C.C. §10-5-16.  The violation of Idaho Code §25-2805(2) for a vicious dog results in a misdemeanor.  Because of the serious nature and potential harm caused by vicious animals, it is proposed that the City of Moscow Code regarding wild and/or vicious animals be amended to align itself with the intent of Idaho State Code.  The City Prosecutor, City Attorney's office, and Moscow Police Department are in agreement with this recommendation.

 

ACTION:  Consider the draft Ordinance and provide staff direction.

 

4.      2009 Grant Writing Workshop - Alisa Stone/Jen Pfiffner

On April 16, 2008, the City of Moscow hosted a workshop for "Grant Writing," free of charge to the community.  Sarah Koerber from the University of Idaho assisted and a power point presentation was jointly developed.  Mayor Chaney welcomed everyone and shared an opening statement and there were several guest speakers.  Marketing of the workshop included a press release that was sent to all local media outlets and briefs, stories were ran by both the local newspapers and radio stations, and distribution of the event flyer throughout the city which requested pre-registering.  Each participant received a folder which included several handouts regarding sources, tips for grant writing, sample applications and a City of Moscow pen.  Approximately 60 people attended, including 10+ walk-ins which worked out because 10 people who preregistered did not show.  Evaluation forms were received from 45 of the participants.  Recipients of funding from the City of Moscow Community Grant Program and all City Commission members were sent a direct invitation.  Participants were from all over the Palouse, as far south as Lewiston and as far as Plummer to the north.  Staff time to prepare and present the workshop included 38 hours Grants Coordinator, 12 hours Assistant to City the Supervisor and 6 hours Administrative staff time.  A second workshop would take approximately half this time as the same format would be used but different information would be presented. Staff will investigate the potential of applying for a grant from a local funder to cover workshop costs this year.

 

ACTION:  Accept report and provide feedback.

 

5.      Draft Ordinance to Add Additional Appeals Procedures for Various Business Licenses - Randy Fife

A recent review of Title 9 revealed that certain business licenses issued by the City do not provide for an appeal process when they are denied, suspended, or revoked.  The City Attorney recommends that an appeal process be created for the general business license (circuses, etc.); secondhand dealers and pawnbrokers; taxicabs; and solid waste haulers, in order to meet due process and fairness requirements.  The addition of an appeals process will also help the City to create a factual, evidentiary and procedural record.

 

ACTION:  Recommend approval of the Ordinance with or without changes; or reject the Ordinance; or take other action as deemed appropriate.

 

6.      Request by Waste Management, Inc. to Assign Solid Waste Export Contract to Waste Connections of Idaho, Inc. - Gary J. Riedner/Randy Fife

The City has received a request from Waste Management, Inc. to assign its right under the contract to Waste Connections of Idaho, Inc. which is the company that has been subcontracting the actual hauling of municipal solid waste from the Latah Sanitation Transfer Station to Waste Management's landfill at Arlington, Oregon.  The terms of the contract between the City of Moscow and Waste Management contains a provision which allows for assignment with the City's written consent. Staff reviewed and edited the document and recommends approval.  Reviewed by the Administrative Committee on January 12 and 26, 2009.

 

ACTION:  Recommend approval of the assignment or take such other action deemed appropriate.

 

7.      Moscow School District License Agreement - Alisa Stone/Gary J. Riedner

After receiving approval from the City Council to submit an application to the Idaho Department of Parks and Recreation for funding to improve Paradise Path from Heron's Hideout to Carol Ryrie Brink Nature Park, staff met with Moscow School District Superintendent Dr. Candis Donicht to inform her that the City was applying for the grant and that, if awarded, we would be able to pave the existing dirt path on the north end of the Joseph Street Property parallel to Paradise Creek within the Brink Nature Park.  At that time, staff was informed by Dr. Donicht she was not in favor of this project.  Subsequently, City Supervisor Gary Riedner and Dwight Curtis, Parks and Recreation Director, met with Dr. Donicht and she agreed to review a license agreement to be drafted by the City Attorney which would allow use of the property under certain requirements.  On February 5, 2009, the City Supervisor and City Attorney received a letter from Dr. Donicht informing the City that she felt it is not in the best interest of the School District to allow the improvements to the path.

 

ACTION:  Staff would like direction from Committee/Council on how to proceed.

3.      Safe Routes to School Contract - Alisa Stone/Les MacDonald

The University of Idaho and the City of Moscow jointly applied for a SR2S grant for FY2009 funding.  The City, on behalf of the U of I, was awarded $10,000 to perform the non-infrastructure activities to include Education, Encouragement and Evaluation for schools with grades K-8 in the Moscow School District.  The City of Moscow was awarded $70,000 for the installation of 1,000 square yards of new concrete sidewalks on "B" and Garfield Streets to provide connectivity between Lena Whitmore Elementary and Moscow Junior High School.  The Engineering Department will provide design and construction management services as in-kind match for the grant award.  The City of Moscow is the fiscal agent for the grant project and therefore must execute an agreement with the Idaho Transportation Department.

 

ACTION:  Recommend approval of the Contract and Resolution or take such other action deemed appropriate.
