The Moscow Mayor, City Council and Staff welcome you to tonight's meeting. We appreciate and encourage public participation. For regular agenda items, an opportunity for public comment is sometimes provided after the staff report. However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations may be placed on the time allowed for comments. Citizens wishing to comment on business that is not on the agenda will be provided the opportunity to do so as item number 3. If you plan to address the Council, you will find a list of "Tips for Addressing the Council" in the door pocket outside the City Council Chambers. Thank you for your interest in City government.
RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance. Contact a Council-member with examples to share at future meetings.

C. Salisbury Park Naming Request - Dwight Curtis
Members of Jemca Development have requested the City park property, presently referred to as Salisbury Park, be officially named, Milton Arthur Park in memory of Milton Arthur Salisbury. Mr. and Mrs. Salisbury moved to Moscow in 1941, purchasing the property in 1951. His family farmed this land until the recent development of the Southgate subdivision only a few short years ago. Please see the attached letter from Jemca Development. The City's Park and Recreational Facilities Naming Resolution 2004-19 was correctly followed through this process. Through the 60-day public comment period there were two alternative suggestions; 1) Lee Newbill Memorial Park, and 2) Sarah Parks Park. The Parks and Recreation Commission recommend the proposed park name of Milton Arthur Park. Reviewed by the Administrative Committee on August 10, 2009.
ACTION: Approve the name Milton Arthur Park.
D. Heart of the Arts Quarterly Report - Dwight Curtis/Jenny Sheneman
Heart of the Arts, Inc. (HAI) took over operations/management responsibilities of the 1912 Center on May 1, 2007. Staff and HAI officials meet regularly to discuss issues, finances, and status. HAI will report to the City Council quarterly on the progress of the operation and renovation efforts. This particular report covers since April, 2009. Reviewed by the Administrative Committee on August 10, 2009.
ACTION: Accept report.
E. FY 09 Recovery Act: Edward Byrne Memorial Justice Assistance Grant (JAG) Formula Program: Local Solicitation - David Duke/Alisa Stone
The City of Moscow has been notified the application for funds authorized by FY09 Recovery Act: Edward Byrne Memorial (JAG) Formal Program has been approved by the Office of Justice Programs. The allocated amount awarded to the City is $23,703. The City Council authorized submittal for this grant under the American Recovery and Reinvestment Act of 2009 on April 20, 2009. JAG funded projects are focused on improving the effectiveness and efficiency of criminal justice systems, processes, procedures. The Police Department plans to coordinate the purchasing of Mobile Data Terminals (MDTs) with supporting software with the Information Systems (IS) Department. It is anticipated the $23,703 allocation will provide for the purchase of two (2) mobile data terminals with software and ancillary connectivity equipment for the four (4) years of the grant period. The MDTs will be installed in marked patrol units MPD-2 and MPD-4. Grant funds will also be used to pay for up to ten (10) percent of the award for costs associated with administrating JAG funds. The Moscow Police Department and the Grants Coordinator will jointly act as the fiscal agent with oversight from the Finance Director in meeting the required administrative responsibilities. No local matching funds are required. Reviewed by the Administrative Committee on August 10, 2009.
ACTION: Approve acceptance of the $23,703 allocation awarded to the City of Moscow by the BJA.

Public Comment and Mayor's Response Period (limit 15 minutes) - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes. Mayor will respond to comments from previous meeting.
4. Sojourners Facility Repair Request - Bill Belknap/Gary Riedner
Sojourner's Alliance is a local non-profit organization that provides longer term transitional housing to homeless individuals and families in need. Sojourner's operates five buildings in Moscow, containing nine residential units. Sojourner's recently discovered that two of their facilities (one family unit and one women's unit) experienced extensive structural damage that apparently resulted from water leaking from several shower facilities. This damage affects 37% of Sojourner's available housing. Sojourner's has obtained three bids for the necessary repairs with a range from $22,000 to $30,000. Council has requested that City staff work with Steve Bonnar, Sojourner's Executive Director, to assess the impact of the damage to Sojourner's operation and to identify possible opportunities for the City to assist with repairs. The City has subsequently received a request from Sojourner's for the City to fund 50% of the required repairs for a total maximum contribution of approximately $15,000. Sojourner's has approached Idaho Housing and Finance Association and several other entities to raise the remaining funds. Mr. Bonnar indicates that he has received a positive communication from IHFA and that he will have additional details perhaps by Monday's Public Works/Finance Committee Meeting. Staff has identified available funding from the Affordable Housing Participation line item (101-140-10-670-26) that could be utilized for this purpose. The Chair of the Fair and Affordable Housing Commission, Karl Johnson, has indicated his support for the proposed use of the funds. Reviewed by the Public Works/Finance Committee on August 10, 2009.
ACTION: Provide staff direction regarding the proposed funding request; or take other action as deemed appropriate.
5. Draft Ordinance Amending Water Service Deposits - Randy Fife
Moscow City Code § 5-4-15 authorizes the City to require a deposit of twenty dollars ($20) in case of new applicants or in case of habitual delinquent payments related to receipt of water services within the City. Due to an inadvertence, this provision was not amended in 1998 to refer to the Council's ability to set fees by Resolution. The proposal is meant to bring this provision into agreement with other provisions of the Moscow City Code and to allow the Council to set the deposit fee by Resolution. Reviewed by the Public Works/Finance Committee on August 10, 2009.
ACTION: Approve Ordinance under suspension of the rules requiring three complete and separate meetings and that it be read by title and published by summary; or consider the Ordinance on first reading and that it be read by title; or reject the Ordinance; or take such other action deemed appropriate.
6. Council Meeting Schedule - Gary J. Riedner
The first Council meeting in September falls on Labor Day and will be rescheduled for Tuesday, September 8th.
