The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations will be placed on the time allowed for comments.  Citizens wishing to comment on business which is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" on the table outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings. 

 

1.       Consent Agenda:  Any item will be removed from the consent agenda at the request of any member of the Council and that item will be considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of December 15, 2008 - Stephanie Kalasz

 

B.     Excavation Permit Security Deposit Policy and Rates - Les MacDonald

The City of Moscow code requires that prior to the performance of excavation or the filling of excavations on public property an excavation permit must be issued for the proposed work.  In addition, a security deposit must accompany the application for the permit.  This deposit is intended to ensure that the public property is restored after the excavation work is completed.  In the event that the applicant does not complete the project or the restoration in a manner acceptable to the City the security deposit can be used to remedy the situation.  The City Code indicates that the security deposit shall be in an amount up to Two Thousand Dollars ($2,000) and in accordance with the rate schedule adopted by the City Council.  The attached resolution will establish a rate schedule for excavation security deposits.  This topic was presented to the Public Works/Finance Committee on November 24, 2008.  The Committee requested edits to the proposed rate schedule.  In addition, the City Attorney indicated a need to confirm that the proposed methodology of establishing the rates was appropriate.  The rate structure proposed has been modified in the attached resolution in accordance with the request of the Committee.  The City Attorney has confirmed the methodology to be used to establish the rates and this is also reflected in the attached draft resolution. Reviewed by the Public Works/Finance Committee on December 22, 2008.

 

ACTION:  Approve the resolution establishing an excavation permit security rate schedule.

 

C.     Renewal of Secondhand/Pawn License for Now and Then - Stephanie Kalasz

Patricia Woodbury has applied for renewal of her secondhand/pawn license for Now and Then.  The application was forwarded to Chief Weaver who recommended approval.  Reviewed by the Administrative Committee on December 22, 2008.

 

ACTION:  Approve the renewal of the Secondhand/Pawn License for Patricia Woodbury of Now and Then.

 

D.     CTAI Grant - Alisa Stone

The CTAI is a 501(c)(3) nonprofit trade association located in Boise which represents Idaho transit agencies.  CTAI acts as a coordinator for the Idaho Transit Coalition (ITC), an informal coalition, to obtain congressional earmarked funds for capital funding for transit agencies from the Federal Transit Administration, Capital Program (49 U.S.C. Section 5309) Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).  CTAI enters into an agreement with a public affairs and governmental relations consulting firm to provide transportation funding consulting services on behalf of ITC.  The City of Moscow, a member of ITC since 2005, has entered into annual agreements with CTAI to seek capital funding for improvements for the various fixed-route bus stop locations.  The City has received the FY 2010 Agreement to be executed between CTAI and the City of Moscow.  As shown on the attached final version of the "2010 Congressional Earmark 5309 Transit Capital Projects" spreadsheet the fees for the City of Moscow will be $1,500 to CTAI and $1,299.52 for the Consultant for a total of $2,799.52.  Ken Burgess of Veritas Advisors, LP, is encouraging the larger participants to decrease their request amounts, and if this happens, our fee will also be reduced.  Staff is currently preparing an application with total project costs of $245,000 to include $196,000 of federal funding with a $49,000 local match.  Reviewed by the Administrative Committee on December 22, 2008.

 

ACTION:  Approve the execution of the Mayor's signature on the CTAI Agreement as a coalition member of ITC and to pay the invoice in the amount of $2799.52 to CTAI for consulting and association fees.

 

E.      Police Grant Letter of Intent - Alisa Stone

The U.S. Department of Justice recently announced a new round of grant funding for a prior application submitted by the Police Department that was not funded.  A non-binding Letter of Intent was submitted on December 18, 2008, as required in the program announcement.  The final application is due via Grants.gov on January 16, 2009.  If awarded this would be a collaborative project with the University of Idaho Violence Prevention and Services Program and the Alternatives to Violence on the Palouse (ATVP), Inc. of Whitman County, Washington and the Latah County, Idaho.  The purpose of the funding is to allow law enforcement and community based victim service providers the ability to carry out mandatory arrest laws while providing additional services to victims of domestic violence and protection order violations.  The funding for the equipment will allow the project partners to obtain mobile data computers, software, support equipment and digital radio communications systems in addition to training that is critical to a region wide data sharing network designed to enable officers to obtain data while in the field.  The anticipated grant request amount will be approximately $400,000.  There is no cash match for the program, however; a great deal of training and staff time will be needed to fulfill the grant requirements.  The award period for this grant is 24 months and continued or supplemental funding is not guaranteed.  The City Attorney will revise a previously prepared Draft Memorandum of Understanding between the collaborative partners which is required to be submitted with the grant application.  Reviewed by the Administrative Committee on December 22, 2008.

 

ACTION:  Approve the submittal of the grant application for the OVW FY 2009 Grants to Encourage Arrest Policies and Enforcement of Protection Orders.

 

 

F.      DEQ Grant for Drinking Water and Wastewater Systems Letter of Intent - Alisa Stone

The Drinking Water Planning Grant Program assists entities that manage public water systems to achieve and maintain compliance with state and federal drinking water standards and to protect public health.  DEQ has announced the acceptance of Letters of Interest (LOI) to participate in the planning grant program which are due January 16, 2009.  The planning grants provide up to 50% of the cost of developing a Facility Plan or Engineering Report in preparation for project feasibility, design, and construction.  Surface water has been identified as a potential means to gain additional water levels in the City's water supply wells.  The City would like to identify the feasibility of surface water impoundment for replacement of potable and/or irrigation water supplies.  The Public Works Director has included sufficient funding to match this request in the FY 2009 budget.  Reviewed by the Administrative Committee on December 22, 2008.

 

ACTION:  Approve the submittal of the "Letter of Interest" to DEQ to request assistance from the Drinking Water Planning Grant program for a Surface Water Reservoir Feasibility Study.

 

G.     Time Warner Rack Space Lease - Jesse Flowers

Staff has been approached by Time Warner Cable with a request to lease five Units of rack Space from the City. Staff has prepared a draft lease agreement the lease agreement would be for a term of 3 years.  Reviewed by the Public Works/Finance Committee on December 22, 2008.

 

ACTION:  Approve the Lease with Time Warner Cable.

 

2.       Mayor's Appointments - Mayor Chaney

 

3.       Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting. 

 

4.       Council Organization

Idaho Code Section 50-702 requires the election of a president of the Council. City Ordinance 91-11 calls for a vice-president to be elected.  Additionally, the Council will organize itself in a manner to work on programs, policies, and projects.  The Council has traditionally been organized into two committees, the Public Works/Finance Committee and the Administrative Committee.  

 

ACTION:  

a.  Elect a Council President and Vice President; 

b.  Establish a working structure for the Council. 

 

5.       Idaho Department of Parks and Recreation - Recreational Trails Program (RTP) - Alisa Stone

The Recreational Trails Program (RTP) of 1998 established a program for allocating funds to States for recreational trails and trail-related projects.  The Idaho Department of Parks and Recreation (IDPR) is responsible for the administration of the Recreational Trail Program (RTP) in the state of Idaho.  The RPT has a category designed for non-motorized diverse use projects primarily intended to benefit more than one mode of non-motorized recreational trail use such as walking, bicycling, and skating; both pedestrian use in the summer and cross-country ski use in the winter.  This program has been identified to assist in the purchase and improvement of an undeveloped section of the Paradise Path system.  In order to develop this section of the path, staff is proposing to purchase two small sections of property located near Heron's Hideout and improving the path system from Mountain View through the Carol Ryrie Brink Nature Park connecting south through Heron's Hideout back to Mountain View.  This completed connection will provide 2.34 miles of walking/biking systems from Mountain View near White Avenue to the north end of Mountain View Park.  The proposed project is a key component in providing access to all of the connections from the largest section of Moscow's residential population from Hwy. 8 and north to Mountain View Park.  Taking this step forward in purchasing the necessary property near Heron's Hideout and developing the path is key to development of a multi-modal transportation system to provide safe and recreational routes for the heavily populated east side of the City.  Reviewed by the Administrative Committee on December 22, 2008.

 

ACTION:  Approval by City Council to submit a grant application to include Budget Option A to the IDPR under the RTP program for the purchase of the Gale and Jaborra properties and the development of the Paradise Path system through Heron's Hideout and Carol Ryrie Brink Nature Park or take such other action deemed appropriate.
