1.      A. Public Comment and Chair's Response Period (limit 10 minutes)
- For members of the Public to speak to the Committee regarding matters
NOT on the Agenda and not currently pending before the Council, Planning
and Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.  

 

B. Approval of Minutes November 13, 2007 - Stephanie Kalasz

 

2.      Request to Expand Human Rights Commission - David Duke

The Human Rights Commission has recommended increasing their membership
from the current five (5) to seven (7) members to a larger group of nine
(9) to eleven (11) members.  They are seeking more contribution and
representation from college students associated with the University of
Idaho along with students currently attending the Moscow High School.
This change would require amending Moscow City Code Title 3, Chapter 12,
Section 2A.

 

ACTION:  Recommend approval of the Ordinance; or recommend rejection of
the Ordinance or take such other action deemed appropriate.

 

3.      Proposed Parkland Dedication Ordinance Changes - Bill
Belknap/Dwight Curtis

The City's Subdivision Code currently includes a provision requiring
that parkland be dedicated as part of any subdivision of property for
development in order to service the needs of future residents and
visitors of such developments.  The Code also provides for the
opportunity for the developer to pay a fee in lieu of the dedication of
land where the circumstances of the subject property or development
warrant. Over the last few years, there has been some confusion as to
whether the City has the ability to specify which option is in the
City's best interest, or whether the developer is able to make that
decision independent of the City.  Staff has prepared a draft Ordinance
for consideration which would clarify that the City retains the right to
determine whether to accept a dedication of land or a fee in lieu of
land.  One additional feature of the draft Ordinance is the addition of
a provision that would allow the City to accept a dedication of land and
improvements, thus allowing the developer the option of providing a
smaller but fully developed park at the City's discretion.  The City
Council conducted a public hearing on this matter on September 4th and
considered the proposed Ordinance on first reading with instruction for
staff to improve the language related to the payment in lieu of
dedication.  Staff has completed the revision and the resulting
amendments are shown in bold on the draft.

 

ACTION:  Recommend approval of the Ordinance; or recommend rejection of
the Ordinance or take such other action deemed appropriate.

 

4.      Proposed Noise Ordinance Revision - David Duke

At the Administrative Committee meeting on November 13, 2007, the
Committee requested changing the language of the proposed change to less
subjective language in the definition of a violation.

 

ACTION:  Recommend approval of the Ordinance; or recommend rejection of
the Ordinance or take such other action deemed appropriate.

 

5.      Discussion Regarding Unauthorized Weapons in Public Facilities -
Randy Fife

In response to concerns related to the presence of firearms, Randy Fife
wrote a letter to the Attorney General's office requesting an opinion
regarding the extent, if any, to which the City could regulate firearms.
The Attorney General responded in a letter dated September 18, 2007
stating that the City could not, on its own, regulate "ownership,
possession, or transportation" of firearms in the City.  Mayor Chaney
wrote a letter to the local State representatives regarding the matter
on October 29, 2007.  Shirley Ringo responded to the Mayor's letter on
November 5, 2007.

 

ACTION:  Consider having a Resolution drafted for Council consideration
as well as drafting legislative language to be submitted to
Representative Ringo or take such other action deemed appropriate.

 

6.      Discussion of Allowing the Charter Schools to use the HIRC at No
Cost Similar to What is Done for the Moscow School District - Dwight
Curtis

Presently Parks and Recreation Department policy allows the Moscow
School District to utilize the HIRC and Eggan Youth Center without a fee
for various school functions throughout the school year. School
functions at the Eggan include Problem Solvers and Insomnia Outbreak
meetings.  School functions at the HIRC are primarily inside PE sport
activities.  As a trade-off, the School District allows the use of a
gymnasium and a classroom for Parks and Recreation programs without a
fee.  There is no formal written agreement for this, but it has worked
well for both organizations.  Staff was asked to bring this issue to the
Administrative Committee for discussion.  Citing the School District's
no-fee use of the HIRC, Moscow Charter School has requested the use of
the HIRC free of charge, which has been declined by the Department based
on no reciprocal advantage to the City. The Charter School is charged
the governmental rate of $15/hr for the use of the multipurpose room and
$25/$50 for gymnasium.  The breakdown of facility usage by all three
entities is included on the staff report.

 

ACTION:  Leave present policy in place or take such other action deemed
appropriate.

 

7.      Airport Agreement Related to Fire Flow Project Funding - Don
Palmer/Randy Fife

The parties to the Pullman-Moscow Regional Airport Cooperation Agreement
wish to fund an Airport Fire Flow Project from 2009 through 2028.  The
project includes a reduced pressure principle detector backflow
prevention assembly (RPDA) with master water meter located in a vault at
the point of connection to the source pipe.  A transmission pipe will be
constructed along the airport frontage in order to supply the 3500 gpm
flow without excessive velocities and head loss.  An approximately
420,000 gallon low-profile steel reservoir will be constructed along the
north side of Airport Road.  The transmission main will be open cut and
patched across Airport Road.  The low-profile storage reservoir will be
designed to satisfy the Federal Aviation Administration primary surface
requirements.  The 3500 gpm fire pump assembly will be housed in a
simple building and will be equipped with a standby generator to provide
100 percent redundancy during a power outage.  Fire hydrants will be
constructed at approximately 300-foot spacing to provide fire flow
coverage throughout the site.  

 

ACTION:  Discuss and recommend approval of the Agreement or take such
other action deemed appropriate.

1.      Approval of Minutes November 13, 2007 - Stephanie Kalasz

 

2.      Palouse River Drive Ball Fields Discussion - Dwight Curtis/Les
MacDonald

City Engineering recommends that a north/south road be constructed on
the eastern side of the park property located on West Palouse River
Drive.  This road would partially service any future expansion to the
south.  There are presently no south roads off of West Palouse River
Drive between the ball field property and Highway 95.  The Parks and
Recreation Staff, the Parks and Recreation Commission, and the Fields
Planning Committee request that the City Council authorize the planning
staff not to be required to construct a road through this property.
Parks and Recreation staff does not dispute the need for an orderly
connecting road expansion system, but requests an exception be made in
this case for the overall good of the intended use of this ball field
park.  

 

ACTION:  Recommend authorizing staff not to be required to construct a
north-south road through the West Palouse River Drive ball field park
property; or if the City Council decides to require the north-south road
across the property, recommend that it be located on the western
panhandle area so as not to interfere with the ball field site; or take
such other action deemed appropriate.

 

3.      Gritman Parking Agreement - Gary J. Riedner

Gritman Medical Center is requesting the City of Moscow to amend the
June 27, 2002 agreement relating to provision of public parking, which
provided public parking in two parking lots south of Gritman's main
entrance.  This agreement was a consequence of Gritman's request to
vacate a portion of Eighth Street between Main and Washington Streets in
2002.  A consideration by the City Council in its determination that
such vacation was in the public interest, was provision of public
parking at least equal to those spaces which would be lost as a
consequence of the vacation of Eighth Street.  Transportation Commission
reviewed this request at its April 26, 2007 meeting.  A copy of the
minutes is attached for committee reference.

 

ACTION:  Review the request and attached information and provide
direction.

 

4.      Request for Affordable Housing Participation - Rick Beebe,
Greenacres Development

The City has received the attached letter of request from Rick Beebe and
Larry Germer of Green Acres LLC, requesting that the City financially
participate in the Green Acres project to assist in providing affordable
housing within Moscow.  Specifically, they request that the City
contribute $100,000 to a proposed Latah County Housing Authority to be
administered by IHFA, and which would be utilized for assistance in a
workforce housing program.

 

ACTION:  Receive report and direct staff as deemed appropriate; or take
such other action deemed appropriate.

 

5.      Third Street Pedestrian Bridge - Linda Pall

 

6.      Safe Passing of Bikes Legislation - Les MacDonald/Phil Cook

Rep. Trail is willing to carry legislation on safe passing of bicycles.
The Transportation Commission has discussed the topic on at least two
occasions.  If the Committee chooses to process, Rep. Trail would like
to have draft legislation by December 13th.

 

ACTION:  Recommend draft legislation or take such other action deemed
appropriate.
