text-decoration:none'>The City’s Subdivision Code currently includes a
provision requiring that parkland be dedicated as part of any subdivision of
property for development in order to service the needs of future residents and
visitors of such developments. The Code also provides for the opportunity for
the developer to pay a fee in lieu of the dedication of land where the
circumstances of the subject property or development warrant. Over the last few
years, there has been some confusion as to whether the City has the ability to
specify which option is in the City’s best interest, or whether the
developer is able to make that decision independent of the City. Staff has
prepared a draft Ordinance for consideration which would clarify that the City
retains the right to determine whether to accept a dedication of land or a fee
in lieu of land. One additional feature of the draft Ordinance is the addition
of a provision that would allow the City to accept a dedication of land and
improvements, thus allowing the developer the option of providing a smaller but
fully developed park at the City’s discretion. The City Council
conducted a public hearing on this matter on September 4<sup>th</sup> and
considered the proposed Ordinance on first reading with instruction for staff
to improve the language related to the payment in lieu of dedication. Staff
has completed the revision and the resulting amendments are shown in bold on
the draft.<o:p></o:p></span></font></p>

the local State representatives regarding the matter on October 29, 2007.

without a fee for various school functions throughout the school year. School
functions at the Eggan include Problem Solvers and Insomnia Outbreak meetings.
School functions at the HIRC are primarily inside PE sport activities. As a
trade-off, the <st1:place w:st="on">School District</st1:place> allows the use
of a gymnasium and a classroom for Parks and Recreation programs without a fee.
There is no formal written agreement for this, but it has worked well for both
organizations. Staff was asked to bring this issue to the Administrative
Committee for discussion. Citing the School District’s no-fee use of the
HIRC, <st1:place w:st="on"><st1:PlaceName w:st="on">Moscow</st1:PlaceName> <st1:PlaceName
w:st="on">Charter</st1:PlaceName> <st1:PlaceType w:st="on">School</st1:PlaceType></st1:place>
has requested the use of the HIRC free of charge, which has been declined by
the Department based on no reciprocal advantage to the City. The <st1:place
w:st="on"><st1:PlaceName w:st="on">Charter</st1:PlaceName> <st1:PlaceType
w:st="on">School</st1:PlaceType></st1:place> is charged the governmental rate
of $15/hr for the use of the multipurpose room and $25/$50 for gymnasium. The

Pullman-Moscow Regional Airport Cooperation Agreement wish to fund an Airport
Fire Flow Project from 2009 through 2028. The project includes a reduced
pressure principle detector backflow prevention assembly (RPDA) with master
water meter located in a vault at the point of connection to the source pipe.
A transmission pipe will be constructed along the airport frontage in order to
supply the 3500 gpm flow without excessive velocities and head loss. An
approximately 420,000 gallon low-profile steel reservoir will be constructed
along the north side of <st1:Street w:st="on"><st1:address w:st="on">Airport
Road</st1:address></st1:Street>. The transmission main will be open cut and
patched across <st1:Street w:st="on"><st1:address w:st="on">Airport Road</st1:address></st1:Street>.
The low-profile storage reservoir will be designed to satisfy the Federal
Aviation Administration primary surface requirements. The 3500 gpm fire pump
assembly will be housed in a simple building and will be equipped with a
standby generator to provide 100 percent redundancy during a power outage.
Fire hydrants will be constructed at approximately 300-foot spacing to provide
fire flow coverage throughout the site. <o:p></o:p></span></font></p>

This road would partially service any future expansion to the south. There are
presently no south roads off of <st1:Street w:st="on"><st1:address w:st="on">West
Palouse River Drive</st1:address></st1:Street> between the ball field
property and Highway 95. The Parks and Recreation Staff, the Parks and
Recreation Commission, and the Fields Planning Committee request that the City
Council authorize the planning staff not to be required to construct a road
through this property. Parks and Recreation staff does not dispute the need
for an orderly connecting road expansion system, but requests an exception be
made in this case for the overall good of the intended use of this ball field
park. <o:p></o:p></span></font></p>

This agreement was a consequence of Gritman’s request to vacate a portion
of <st1:Street w:st="on"><st1:address w:st="on">Eighth Street</st1:address></st1:Street>
between <st1:place w:st="on">Main</st1:place> and Washington Streets in 2002.
A consideration by the City Council in its determination that such vacation was
in the public interest, was provision of public parking at least equal to those
spaces which would be lost as a consequence of the vacation of Eighth Street. Transportation
Commission reviewed this request at its April 26, 2007 meeting. A copy of the
minutes is attached for committee reference.<o:p></o:p></span></font></p>
