1.      A. Public Comment and Chair's Response Period (limit 10 minutes)  - For members of the Public to speak to the Committee regarding matters NOT on the Agenda and not currently pending before the Council, Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  

 

B. Approval of Minutes June 25, 2007 - Laurie Lewis

 

2.      Sidewalk Café Ordinance - Randy Fife

City wishes to consider licensing businesses in the Central Business (CB) Zoning District to allow use of adjacent sidewalks for sidewalk cafes in the public rights-of-way within certain limitations.

 

ACTION:  Review proposed Ordinance and direct staff as deemed appropriate.

 

3.      Palouse Pride 2007 Alcohol Permit Request for East City Park - Dwight Curtis

In accordance with Moscow City Code 5-13-4(B), the Palouse Pride has requested that the Council pass a Resolution allowing them to have a beer-wine garden for the Palouse Pride event to be catered by Sandpiper Grill in East City Park, on Saturday, July 28th from 12:00 p.m. to 4:00 p.m.  There will be food vendors, live music and other activities at the event.  

 

The licensed vendor will sell alcohol to adults with proof of age in one designated, roped off area.  Rendezvous in the Park Palouse Pride event organizers will provide their own security, which is supported by Moscow Police Chief, Dan Weaver.

 

ACTION:  Consider request and direct staff as deemed appropriate.

 

4.      Moscow Motorcycle Classic 2007 Proposed Beer-Wine Sales Permit For Friendship Square - Dwight Curtis

In accordance with Moscow City Code 5-13-4(B), the Moscow Chamber of Commerce has requested that the Council pass a Resolution allowing them to have a beer-wine garden for the Moscow Motorcycle Classic event to be catered by The Plantation in Friendship Square for the Moscow Motorcycle Classic 2007, on Saturday, July 28th from 7 p.m. to 10 p.m.  

The licensed vendors will sell alcohol to adults with proof of age in one designated, roped off area. Event organizers will hire a minimum of Moscow police officers to be on site throughout the beer-wince garden open operation time. The cost is $35 per hour per officer. This is recommended by Moscow Police Chief Dan Weaver.

The event's sponsors have already received a permit to close Main Street from mid-block between 3rd Street to and including 5th Street for the event. The event includes a street dance and the beer-wine garden.  

 

ACTION:  Consider request and direct staff as deemed appropriate.

 

5.      Proposed Amendment Regarding Parkland Dedication - Bill Belknap

The City's Subdivision Code currently includes a provision that requires that parkland be dedicated as part of any subdivision of property for development in order to service the needs of the future residents and visitors of such developments.  The Code also provides for the opportunity for the developer to pay a fee in lieu of the dedication of land where the circumstances of the subject property or development warrant. Over the last few years, there has been some confusion under the current Code as to whether the City has the ability to specify which option the City believes to be in the City's best interest, or whether the developer was able to make that decision independent of the City. Staff has prepared a draft ordinance for consideration (attached) that would clarify that the City shall retain the right to determine whether to accept a dedication of land or a fee in lieu of land for the Commission's consideration.  One additional feature of the draft ordinance is the addition of a provision that would allow the City to accept a dedication of land and improvements, thus allowing the developer the option of providing a smaller but fully developed park at the City's discretion.

 

ACTION:  Receive report and direct Staff as deemed appropriate; or take such other action as deemed appropriate.
