1. A. Public Comment and Chair's Response Period (limit 10 minutes)
- For members of the Public to speak to the Committee regarding matters
NOT on the Agenda and not currently pending before the Council, Planning
and Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.
B. Approval of Minutes April 9, 2007 - Stephanie Kalasz
2. Proposed Neighborhood Meeting Ordinance - Bill Belknap
On March 5th, the City Council Passed Resolution 2007-04 which defined a
neighborhood meeting process that if followed would allow multiple land
use applications to be processed concurrently, or bundled, as they had
in the past. At that time, staff advised the Council that staff would
formulate the contents of the Resolution into Ordinance format so the
process could be incorporated within the City Code. The proposed
Neighborhood Meeting Ordinance was considered by the Planning and Zoning
Commission at a public hearing on April 11th. The Commission
recommended approval of the Ordinance with a few minor amendments. The
Commission's proposed amendments are shown in the attached legislative
version of the Ordinance. This matter has been scheduled for public
hearing before the City Council at the May 7th meeting.
ACTION: Review the proposed Neighborhood Meeting Ordinance to be
considered by the Council at a public hearing to be held on May 7th; or
take such other action as deemed appropriate.
3. Background Checks Resolution - Dwight Curtis
Staff was directed by the City Council to redraft a Resolution regarding
the proposed background check program for volunteers and staff working
with city run and or sponsored youth programs. The primary issues to
re-address were regarding the appeal process. There were some other
minor language changes as well. The attached Resolution addresses these
issues along with some additional language changes.
ACTION: Recommend approval of the proposed Resolution establishing a
policy for background checks for staff and volunteers who work closely
with minors in city-run or sponsored programs; or take such other action
deemed necessary.
4. Draft Ordinances Regarding Attendance of Elected and Appointed
Officials - Gary J. Riedner
A. Attendance at Meetings for Board, Commission and Committee Volunteer
Members
The draft Ordinance is meant to standardize the service of volunteer
members of the public appointed to the various City Boards, Commissions
and Committees and to allow for their removal where non-attendance has
not been approved of by the Chair. The language in the currently
existing Code related to the adoption of various by-laws, rules of
procedure, or other administrative matters has been removed to promote
consistency across all respective Boards, Commissions and/or Committees.
B. Draft Ordinance Defining Council "Vacancy"
The enclosed draft Ordinance is an attempt to create a definition of
"vacancy" because of Council experience within the last several years
where there have been extended time periods where a Council member has
not been able to participate in Council meetings and other activities.
The Ordinance provides a definition of vacancy which includes matters
involving incarceration for a serious criminal public offense, and
extended absence from all meetings of the Council and from all Council
Committee meetings for more than thirty (30) days within a continuous
forty five (45) day period without the Council's consent. The Ordinance
further provides for a public hearing to determine whether there has
been a "vacancy" due to the absence of a Council member. This Ordinance
would not apply to any current Council member who votes against it but,
if passed, would apply to all subsequently elected Council members.
C. Draft Ordinance Providing for Installation of a Council Member
Filling a Partial Term
Attached please find two (2) Ordinances related to the timing of
installation of a Council member elected to fill an unexpired term
following the election for the term. One version of the Ordinance
allows the elected Council member to be installed at the first Council
meeting in January following the election. The other version allows the
elected Council member to be installed at the first meeting of the
Council following the election.
ACTION: Review Ordinances and direct staff as deemed appropriate.
