B.	Receive P&Z Recommendation on Pickard Comp Plan Map Amendment -
Ackerman

On November 8, 2006 the Planning & Zoning Commission conducted a public
hearing and recommended approval of the request by Michael Pickard to
amend the Comprehensive Plan Map Designation of 505 S. Mountain View Rd.
from Medium Density Residential (MR) to Convenience Commercial (CC).
The Local Land Use Planning Act requires that the Council "receive" the
Commission recommendation prior to publication of the Council hearing
notice.  A Council hearing date of December 4, 2006 is proposed.

 

ACTION:  Receive recommendation.

 

2.      Disbursement Report for October 2006 - Don Palmer

 

3.      Recommend Rejection of Breathing Air Trailer Bid - Mike McGahan

Incorrect specifications were identified in the bid documents
necessitating the need to reject and rebid.

 

      ACTION:  Recommend rejection of breathing air trailer bid or take
such other action deemed appropriate.

 

4.      Biosolids Disposal Options Study Results -Tom Scallorn

The City of Moscow has for the last ten years taken our Wastewater
Treatment Plant sludge to EKO in Lewiston for composting. During the
past year there have been concerns about the long term option to use
EKO. The City of Lewiston was reviewing their options and reevaluating
their contract procedure. The City of Lewiston is the lead agency in
that they administer the Permit issues with sludge disposal such as
sampling and preparing an annual report. The City of Moscow is currently
in the last stages of design that will lead to construction of an
effluent filtration system to address phosphorus removal requirements.
Once constructed, it is anticipated that biosolids production levels
will increase. These issues and others indicated to us the need to
review our options for sludge disposal and to be prepared to pursue
other alternatives if needed.  It is our understanding that the City of
Lewiston is in the process of negotiating a new contract with EKO. The
City of Moscow advertised an RFP to evaluate our existing disposal
practice and to evaluate possible future options. The RFP process
resulted in the selection of Brown and Caldwell Engineering to conduct
an evaluation of biosolids treatment and disposal alternatives.
Communication between WWTP staff and Brown and Caldwell (B&C) produced
an initial list of 11 alternatives for consideration. B&C along with
City Staff developed screening criteria which was used to reduce the
initial list to three preferred alternatives. A Business Case Evaluation
(BCE) was developed for each alternative, using current program costs as
a baseline for comparison. Those three alternatives are:  Diverse
Private Operation;  Anaerobic Digestion; and Anaerobic Digestion with
Facultative Sludge Lagoons.  For both the 10-year and 20-year life-cycle
cost, the lowest cost alternative to the City is to stay with the
existing process at the treatment plant and implement a diversification
program to enhance program reliability.  Brown and Caldwell suggested
that the City pursue the diversification option as a short-term
solution. In the meantime, it is recommended that the City pursue
further detailed evaluation of adding anaerobic digestion, with or
without facultative sludge lagoons.

 

      ACTION:  Receive the report.

 

5.   Latah Sanitation, Inc. - Biosolids Pilot Program Report - Joe
Johnson/Tom Scallorn

The City of Moscow has participated in the Latah Sanitation Biosolids
Pilot Project. The City's involvement in this project was to deliver to
Latah Sanitation (LSI) the amount of Wastewater Sludge previously
approved by the North Central Health District and to assure that the
proper regulatory approvals and protocols were in place. The City is
required by our NPDES Discharge Permit to use only approved disposal
sites and methods.  The City delivered 1000 cubic yards of sludge to LSI
for their use in the pilot compost operation and staff visited the site
several times to assure that the protocols were followed because the
City can be held accountable by EPA for the proper disposal of its
sludge. A summary report for the pilot project was prepared by
CH2M-HILL.  The pilot was successful with respect to odor control,
product quality and capacity to receive sludge in a timely manner. A
draft of this report is included for reference.

D.	City Land Use Process Discussion - Andrew Ackerman / Gary J.
Riedner

For the past year, City land use processes have been changed to provide
for more public involvement relating to annexation, comprehensive plan
amendment, zoning, platting and planned unit developments. Previously,
the City had allowed "bundling" of certain of these processes, allowing
them to proceed at the same time. At the direction of the Mayor, the
processes have been "unbundled", and at the time, most of the processes
proceed independently of each other. This has resulted in a longer,
protracted process that has been perceived to be cumbersome and
uncertain.  To investigate other possibilities, staff has proposed
separating the discussion of the "land use designation" processes
(annexation, comprehensive plan amendments and zoning) from the
"development processes" (platting and planned unit development).  At
this meeting staff will present a proposal for the "land use
designation" processes and will present a proposal for the "development
processes" at a future meeting. 

 

ACTION:    Review proposal and give direction.

  

E.	Annexation Policy Amendment - Joel Plaskon

Resolution 2001-15 establishes the City annexation policy.  It does not
address the matter of zoning of lands proposed for annexation.  However,
the Farm, Ranch and Outdoor Recreation (FR) Zoning District described in
the Zoning Code specifies an intent that newly annexed lands be zoned
FR.  The location of such stated intention has been problematic and
confusing, as one looks to the annexation policy for guidance about
annexation and related issues.  Annexations have occurred without due
consideration of the FR Zoning District application, where annexation
occurs without a simultaneous proposal for rezoning.  Therefore, staff
is proposing to amend the annexation policy to explicitly include
consideration of applying FR zoning at the time of annexation.

 

ACTION:  Accept report and take action as deemed appropriate.

 

F.	Zoning Code Amendment - Limit R-3 to 1 SFD or Duplex per Lot -
Joel Plaskon

There is currently an inconsistency in the Zoning Code where no more
than one single family dwelling is allowed per lot in the R-1 and R-2
Zoning Districts, but the R-3 Zoning District does not specify that only
one single family or duplex dwelling is allowed per lot.  Staff is
unaware as to whether this is intentional or if it is to be assumed that
the one building per lot limitation exists in the R-3 Zoning District.
Developers have been expressing interest in constructing multiple
duplexes on single, oversized lots in the R-3 Zoning District.  It is
often the case that R-3 abuts R-1 or R-2 Zoning and it is not uncommon
for existing R-3 neighborhoods to contain a significant amount of single
family development.  Construction of multiple duplexes on single lots
can have a multi-family development effect in these existing single
family and duplex neighborhoods.  The proposed one dwelling or duplex
per lot specification would create consistency in zoning districts and
reduce the possibility of unintended impacts on R-1, R-2 and R-3
neighborhoods.  The Planning and Zoning Commission conducted a public
hearing and recommended approval of this Code amendment on August 23,
2006. Public Hearing was also held at City Council on November 6, 2006
and the ordinance was considered on first reading.

 

ACTION:  Provide further information regarding proposed ordinance and
receive Committee direction.

 

G.	Proposed Increase in Limit of Compensatory Hours Available for
Non-Exempt Employees - Gary J. Riedner

City Administration has received a request from employees to increase
the maximum per-employee accumulation of compensatory time from the
current level of 50 hours as allowed by the Overtime/On Call Time
portion of the City of Moscow Personnel Policies, Section (3).  This
request for increase was intended to allow managers and employees
additional flexibility to manage overtime and time-off issues. The
matter was discussed by the City Management Team and recommended for
approval.  City Administration is in favor of making the change and
believes that it will allow the flexibility that employees and managers
desire. The current comp time accumulation of 50 hours has worked well
and managers and employees have worked together to achieve the best
results of our limited manpower and static budgets. We believe that an
increase to 80 hours will also provide additional flexibility to work
with. 

 

ACTION: Recommend approval of increase of compensatory time accumulation
from 50 to 80 hours per non-exempt employee or take such other action
deemed appropriate.
