1. Approval of Minutes of May 8, 2006 - Stephanie Kalasz
2. Receipt of Planning & Zoning Commission Recommendation on a
Petition to Amend the Comprehensive Plan Map for 78 acres of land
(Thompson Property) on the east side of Moscow
On March 22, 2006 the Planning & Zoning Commission recommended denial of
a petition to amend the Comprehensive Plan Map for approximately 78
acres from Extensive Commercial (EC) designation to a mix of Light
Industrial (LI) and Low Density Residential (LR). The subject land is
located on the south side of State Highway 8, the east side of South
Mountain View Rd (and 3.8 acres on the west side of S. Mountain View
Rd), and the north side of East Palouse River Dr. The applicant has
requested a Council hearing on the application. The Local Land Use
Planning Act requires that the Council "receive" the Commission
recommendation prior to publication of the Council hearing notice.
ACTION: Acknowledge receipt of Commission recommendation and direct
staff to publish a public hearing notice, or take other action as deemed
appropriate.
3. Biosolids Disposal Options Study Contract - Les MacDonald
The City of Moscow's Wastewater Treatment Plant is designed for
biological nutrient removal serving a total population of approximately
23,000. The Plant is soon to be upgraded to comply with the current EPA
permit requirements for phosphorus (effluent filters), which will
increase the quantity of Biosolids produced and the annual tonnage of
biosolids to be processed and removed. The current disposal method is to
truck the biosolids to EKO in Lewiston for composting. Recent events
surrounding the EKO composting facility in Lewiston and pending
decisions by the Lewiston City Council regarding the disposal of
biosolids and yard waste produced in Lewiston may have an impact on the
EKO operation.
Attached for your review is a proposed Professional Engineering Services
Contract including Exhibit A, which contains the complete scope of work.
The study is to include an estimate of return on investment, estimated
capital expenditure and operational, maintenance, disposal and transport
costs, with inflationary factors over the next ten year period, for
current and proposed biosolids treatment and disposal options, which is
accomplished in the Business Case Evaluation (BCE). Proposed options
may also impact the City's backup disposal plan and such impacts will be
considered and addressed.
The proposed contract was a budgeted item in the 2005 budget but was not
completed and no funds where expended. The current contract, if
approved, is recommended to be funded from the Wastewater Budget,
Professional Services and specifically the Use Attainability Analysis
item which is funded at $50,000 and will not be fully utilized in the
2006 budget.
ACTION: Recommend Council approval or other action as deemed
appropriate.
4. Urban Renewal Agency Annual Report - Gary J. Riedner
Moscow's Urban Renewal Agency is providing its Annual Report for fiscal
year 2005. This report has been compiled in conformance with Idaho Code
Section 50-2006 in which an Urban Renewal Agency is required to file
with the local governing body each year, a report of its activities for
the preceding fiscal year. Due to an oversight, the annual report was
not submitted by March 31, 2006.
In addition to the above stated requirement, Idaho Code further requires
a full and complete audit of its financial statements to be made each
fiscal year. In response to this annual audit requirement, independent
auditor, Presnell Gage recently completed the final audit for 2005. A
copy is attached to this report.
ACTION: Accept report.
5. City/County GIS Data Sharing Memorandum of Understanding - Bill
Belknap
City staff has been working with Latah County to define a mutually
beneficial data sharing relationship that would assist both
organizations with the creation and maintenance of GIS and related data
through a cooperative effort. The proposed Memorandum of Understanding
(MOU) would provide for the transfer of the City's revised parcel layer
to the County, while providing for the sharing of the County's State of
Idaho Tax Commission Database information with the City. The MOU also
defines the process by which future subdivisions will be provided to the
County in digital format, and how those records will be incorporated
within the County's records and shared with the City. Staff believes
that this MOU will bring greater efficiencies to both organizations, and
presents the good starting point for potential broader data sharing
opportunities in the future
ACTION: Recommend approval and authorization of the Mayors signature
upon the proposed GIS Data Sharing MOU between the City of Moscow and
Latah County; or take other action as deemed appropriate.
6. Professional Services Agreement - Hodge
One of the project development stages of the "D" Street project is
preparation of Right-of-Way Plans. Because this is a federal-aid
project, the right-of-way plans will need to be stamped by a registered
land surveyor (LS). Hodge and Associates was chosen from the ITD term
list of pre-approved consultants and because of their involvement in
several surveys along this section of "D" Street. The scope of work will
include overseeing the preparation of the plans, preparing any necessary
legal descriptions for property purchases and affixing LS stamp to the
drawings.
ACTION: Approve the selection of Hodge and Associates as the preferred
consultant for this work and direct staff to place item on the next
Council agenda for approval of Mayor's signature; or take other action
deemed appropriate.

3. Rendezvous in the Park Request for Beer and Wine Garden in East
City Park- Dwight Curtis
In accordance with Moscow City Code 5-13-4(B), Rendezvous in the Park
has requested that the Council pass a Resolution allowing them to have a
beer garden catered by a licensed vendor in East City Park for
Rendezvous in the Park on July 20, 21, and 22 from 5 p.m. to 10 p.m. and
on July 23 from 4 p.m. to 7 p.m. There will be food vendors, live
music, and other activities at the event.
The licensed vendors will sell alcohol to adults with proof of age in
one designated, roped off area. Two Moscow Police officers will be on
site and will be paid for by Rendezvous in the Park.
ACTION: Consider request and direct staff as deemed appropriate.
4. Credenda/Agenda Magazine Request for Beer and Wine Garden in
East City Park- Dwight Curtis
In accordance with Moscow City Code 5-13-4(B), Credenda/Agenda Magazine
has requested that the Council pass a Resolution allowing them to have a
beer garden catered by Patty's Kitchen and a catered beer and wine
garden by Camas Winery in Friendship Square for Credenda/Agenda Magazine
Trinity Fest 2006 on August 8 from 5 p.m. to 10 p.m. There will be food
vendors, live music, a blow-up kid's jungle gym and other activities at
the event.
The licensed vendors will sell alcohol to adults with proof of age in
one designated, roped off area. Two Moscow Police officers will be on
site and will be paid for by Credenda/Agenda Magazine Trinity Fest.
The event's sponsors have already received a permit to close a portion
of Main Street from 3rd Street to 5th Street for the event.
ACTION: Consider request and direct staff as deemed appropriate.
5. Contractor Registration - Jim Johnson
On January 1, 2006 the State of Idaho began requiring contractors who
work in Idaho to register with the Idaho Bureau of Occupational
Licensing. The state law requiring contractor registration also
requires jurisdiction that issue building permits to ask for a
contractor registration number when a building permit is requested.
When a registration number is given it is to be "conspicuously entered
on the face of the permit" or if the contractor is exempt, the statement
"no contractor registration provided" is entered on the face of the
permit. The state law does not specifically say what to do if a
contractor does not have a registration number. Community Development
Department staff is asking for direction on whether or not an ordinance
is appropriate stating "no building permit will be issued unless a
contractor registration number is provided" or whether the state law is
clear enough as written.
ACTION: Recommend passage of ordinance clarifying the intent of the
contractor's registration language or give other direction.
6. Zoning Code Amendments - Joel Plaskon
The Transportation Commission has recommended to the Planning and Zoning
Commission that the Zoning Code be amended to require sidewalks for
developments that have long driveways and no other safe pedestrian
passage from the public street to the development. The Commission
accepted that recommendation. Additionally, staff recommends amendments
to require increased setbacks for garages on street side yards and to
specify that only one single family or duplex dwelling is allowed per
lot in certain zoning districts. The increased garage setback would
minimize the tendency for cars to be parked in the driveway in a manner
that obstructs the public sidewalk. The one dwelling or duplex per lot
specification would create consistency in zoning districts and make it
clear that multiple, detached dwellings cannot be placed on the same
lot, as a matter of right. As a result, staff has drafted the attached
ordinance and requests direction from Council.
ACTION: Accept report and direct staff as deemed appropriate.
