The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 2.  If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting, one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message.  Contact a Council-member with examples to
share at future meetings.

 

1.	Consent Agenda:  Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later.  Approval by roll call vote.

B.     Disbursement Report for February 2006 - Don Palmer

Public Works/Finance Committee reviewed accounts payable for February
2006 and recommends approval of the following:

C.     Ghormley Park Restroom Remodel Bid Award - Roger Blanchard

As a part of the City's Settlement Agreement with the U.S. Department of
Justice, Moscow was required to modify the rest rooms at Ghormley Park
to comply with the Americans with Disabilities Act (ADA).  In 2005, the
City had architectural drawings prepared for the remodel project and an
estimated cost was established.  The rest room remodel project was
included in the capital projects budget for fiscal 2006.  Since the
project was estimated to cost over $25,000, staff advertised for bids
from Idaho licensed Public Works Contractors and personally contacted
several contractors to solicit bids.  On the bid opening date of
February 6, 2006, no bids had been received.  In accordance with Idaho
code, staff then re-opened the bid process to include non-Public Works
Contractors.  Several were contacted and on the bid opening date
(2-22-06), one responsive bid was received from High Country
Construction L.L.C. for $26,700, which was within the budget for the
project.  Reviewed by the Public Works/Finance Committee on March 13,
2006.

 

      ACTION:  Approve bid award to High Country Construction, L.L. C.

 

D.     Memorandum of Understanding for Insight Database Sharing Program
- Dan Weaver

This is memorandum of understanding is for an information sharing
network program between 16 police agencies.  The Nez Perce Tribal Police
Department has received a $75,000 grant to cover the first three years.
Reviewed by the Administrative Committee on March 13, 2006.

 

      ACTION:  Approve Memorandum of Understanding.

 

E.   Weed Control Contract - Mike McGahan

The annual Street Department weed spraying program on City right-of-ways
includes spraying of noxious weeds, street cracks, curb edge cracks and
bare ground weed control around dead end barricades, guard rails,
bridges and fire hydrants.  Shull Brothers has done the weed spraying
services for several years and has a good working relationship with the
Street Department and the public.  Reviewed by the Public Works/Finance
Committee on March 13, 2006.

 

      ACTION:  Approve the weed control contract.

 

2.	Public Comment and Mayor's Response Period (limit 15 minutes) -
For members of the Public to speak to the Council regarding matters NOT
on the Agenda and not currently pending before the Planning and Zoning
Commission or Board of Adjustment, please state your name and address
for the record and limit remarks to three minutes.  Mayor will respond
to comments from previous meeting.

 

3.	Engineering Standard Details Update - Les MacDonald

Moscow City Code references Standard Construction Drawings and
Specifications as requirements for the construction of public streets
and utilities.   The existing standards are for the most part from the
early 1980's.    Engineering staff is suggesting modifications to the
standard drawings in order to both clarify and improve upon the design
and installation of Moscow's public infrastructure.  In 1997, Council
modified and adopted standard drawings pertaining only to the
construction of streets.   The adoption of the drawings herein suggested
only includes some minor clarifications of the street standard
illustrations; nothing dimensional or character in nature.  The written
City standard specifications are not being recommended for modification
at this time but will most likely be edited this year for possible
future adoption.  Reviewed by the Public Works/Finance Committee on
March 13, 2006.

 

ACTION:  Approve the Engineering Standards update and Resolution; reject
the update and Resolution; or take such other action deemed appropriate.

 

4.	JUB WWTP Filter Design Contract - Les MacDonald

As part of the process of constructing the WWTP improvements required to
provide compliance with the City of Moscow's NPDES permit for the
facility, it is necessary to design the proposed filter system.  The
pre-design work of this project was performed by Jim Kimball under a
contract between the City and Kimball Engineering.  During the execution
of the contract work, Kimball Engineering was acquired by JUB Engineers
and work progressed with Kimball Engineering as a subsidiary of JUB.
The pre-design portion of the work is just about complete and it is time
to move into the final design process.  A copy of the proposed contract
for professional services for the final design of the filter plant is
included with this package.  The contract services include the
completion of the design work, development of the construction
documents, provision of support through the bidding process, and
construction management, surveying, and inspection.  Reviewed by the
Public Works/Finance Committee on March 13, 2006.

 

ACTION:  Approve the contract; reject the contract; or take such other
action deemed appropriate.

 

5.	Gas Franchise Renewal Ordinance - Gary J. Riedner

The current natural gas franchise with Avista Utilities expires March 7,
2006.  Staff has been working with Mike Thomason, Regional Manager of
Avista Utilities on a renewal of the franchise agreement and the
proposed ordinance is attached.  Idaho Code section 50-329 states that
an ordinance granting a franchise shall not be passed on the day of its
introduction or the following 30 days and the ordinance must be
published in at least one issue of the official newspaper.  The proposed
ordinance has a term of ten years with a renewal term of fifteen years.
The ordinance is very similar to the electric franchise ordinance which
was passed by the City in 1998.  On March 6, 2006, the Council
considered the Ordinance on first reading and approved extension of the
existing franchise for 60 days.  This Ordinance was considered on first
reading at the March 6, 2006 Council meeting.

 

ACTION:  Consider Ordinance on second reading and that it be read by
title only and direct that it be published according to law; or reject
the Ordinance; or take such other action deemed appropriate.

 

6.       Second Reading of Proposed Amendment to Moscow City Code Title
7, Chapter 1, Section 106 and Title 7, Chapter 13 - Jim Johnson

The Proposed Ordinance is in response to an appeal regarding the
interpretation of the Building Official that the site plan must be
prepared by a registered design professional.  Although the appeal was
resolved, staff thought it prudent to clarify the Code to prevent any
confusion on this matter.  The proposed Ordinance allows for site plan
requirements to be adopted by Resolution of the Council from time to
time.  No such Resolution has been adopted to date, but is proposed by
staff herein.  Additionally, the Ordinance also would remove the
language in Title7 Chapter 13 because it is duplicated in Title 7
Chapter 8, but retain the Chapter number 13 for future use.  The
Administrative Committee reviewed the Ordinance at the January 23rd and
February 27, 2006 meetings.  This Ordinance was considered on first
reading at the March 6, 2006 Council meeting.

 

ACTION:  Approve Ordinance under suspension of rules requiring three
complete and separate readings and that it be read and published by
title only; or consider the Ordinance on second reading; or reject the
Ordinance; or take such other action deemed appropriate.
