Defense attorney in HIV case wants change of venue

MOSCOW -- The attorney for a Moscow man charged with 13 counts of having sex with women without first informing them that he's tested positive for HIV filed a motion for a change of venue. 

Kanay Mubita, 31, has pleaded innocent to all charges and is scheduled for trial on March 27. 

But Latah County Public Defender Charles Kovis said Tuesday that pre-trial publicity in newspapers and on television, coupled with unfounded comments and opinions voiced on a local Internet bulletin board called Vision 2020, make it impossible for his client to receive a fair trial here. 

Kovis, who was assigned to represent Mubita, said he wants the trial moved to another venue, or jurors brought in from outside the county. 

In addition to the motion, Kovis filed an affidavit supporting the motion, along with copies of newspaper clippings and scores of comments and opinions downloaded from Vision 2020. 

Second District Judge John R. Stegner of Moscow is presiding over the matter. 

Thirteen women testified against Mubita at preliminary hearings, all saying they had consensual sex with the defendant, but that he didn't tell them he'd tested positive for the virus that can cause AIDS. 

Mubita remains in the Latah County Jail on a $20,000 bond. He faces a maximum of 15 years in prison and a $5,000 fine for each charge.
