[Vision2020] Zoning Code, Boarders, Wilsonanity

Interested Parties,

Here is the section of the City of Moscow Zoning Code which deals with the enforcement of zoning violations.  It does not appear to be ambiguous:

Sec. 11-7. Complaints Regarding Violations.

Whenever a violation of this Zoning Code occurs, or is alleged to have occurred, any person may file a written complaint.  Such complaint stating fully the causes and basis thereof shall be filed with the Zoning Administrator, who shall record properly such complaint, immediately investigate, and take action thereon as provided by this Zoning Code.

Sec. 11-8. Penalties for Violations.

A. Any person or corporation, whether owner, lessee, principal, agent, employee, or otherwise, who violates any of the provisions of this Zoning Code, or permits any such violation or fails to comply with any of the requirements thereof, or who erects, constructs, reconstructs, alters, enlarges, converts, moves or uses any building or uses any land in violation of any detailed statement or plans submitted by him or her and approved under the provisions of this Title, shall be guilty of a misdemeanor and, upon conviction thereof in a court of competent jurisdiction shall be punished pursuant to this Code and the Idaho Code. Each seven (7) consecutive day's continued violation shall constitute a separate additional violation of this Code.

B. In case any building or structure is erected, constructed, reconstructed, altered, converted or maintained, or any building, structure or land is used in violation of this Zoning Code, the proper legal authorities of the City, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance or use, to restrain, correct, or abate such violation, to prevent any illegal act, conduct, business or use in or about such building, structure or land; and upon the failure or refusal of the proper local officer, board or body of the City to institute any such appropriate action or proceeding, any person aggrieved by such violation may institute such appropriate action or proceeding in like manner as such local officer, board or body of the City is authorized to do.



Notice that anyone, not just a Moscow resident, can file a zoning a complaint.  

Notice also that the Zoning Administrator (Community Development Director Joel Plaskon) is statutorily required to immediately investigate, and take action on any complaint filed.  Those familiar with the boarding house complaints know that this didn't happen.

Notice also that the motivation for filing a zoning complaint is not statutorily addressed:  For enforcement purposes at law, the motivation of the complainants is irrelevant.



There are several interesting aspects of the whine of the Wilson & Family's Cult & Cash Machine claiming religious persecution:

1.    Whether the cult is being persecuted solely because of its beliefs or not is irrelevant at law.  A complaint has been made.  An investigation and appropriate action is statutorily required.  Exempting a particular religious, social, or political group because of persecution claims is not a legal option in the case of any constitutionally correct law.  Either the alleged offender is in violation or not.

Do not think that this is merely the opinion of an ignorant non-believer.  

In the early 1970s, I lived for awhile in Glendale, California.  To make a long, long story very short, a church with the approval of the Glendale City Council started to build a very large church in what was a quiet residential area.  The residents of that area appealed.  The case went all the way to the U.S. Supreme Court twice, who ruled both times in favor of the area residents.  The permit was found void ab initio and the large structure, already partially constructed, was ordered to be leveled.

The case was a complex one with many issues (parking and noise were substantive issues).  However, the church, like our local cult, claimed among other things, religious persecution.  The U.S. Supreme Court said, in effect, such claims are irrelevant if an otherwise constitutionally correct law was being violated.  This is a country of the Rule of Law, not the Rule of Man or some political, social, or religious subset.

Also of note in this case was the stubbornness of the Glendale City Council who cost the city residents a huge amount of tax dollars by trying to justify their clearly illegal actions.  The offending councilpersons were voted out.



When I lived in Boundary County in the 1980s, residents of Bonners Ferry complained about the zoning violations of a particular church (one which many saw as a cult), in particular, noise and acute parking problems were among the complaints.  The city dragged it feet because of the "persecution" and "anti-God" claims of the church.  In the end, after  unnecessary expenses and loss of credibility by the city council defending their non-actions, the church was forced to address the zoning violations.



2.    It seems to me that their are illegal considerations of religious belief occurring in this case.

The city is claiming that the religious beliefs of the complainants are motivating the complaints and hence the complaints should be ignored/not taken seriously.  Clearly this is a case of religious persecution, but not of the cult but rather against the complainants.  The cult is not exempt from constitutionally correct laws no matter what the motivation of the complainants.  If the city bases its actions on their perception of the religious beliefs of the complainants, the city and select officers/staff of the city as individuals may be in for some very costly litigation including a Section 1983 action:

"Sec. 1983. - Civil action for deprivation of rights

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia." 



3.    There is no doubt that the Wilson & Family's Cult & Cash Machine are serial zoning violators.  Perhaps in the world of Wilsonanity [Wilson-Inanity] (an extreme corruption of Christianity) such violations are not sins, hence not criminal, perhaps under the Doctrine of Covenantal Dishonesty.

What is really amazing is that anyone familiar with the cult doctrines can believe that the cult would even dare to talk about religious persecution or discrimination.  The doctrines of the Wilson & Family's Cult & Cash Machine are much more discriminatory and draconian than even those of the Aryan Nations.  [See the words below from the cult's own theological/theocratical repository.  Clearly there are not enough stones in the world (some would have to be used twice) to kill all those they have sentenced to death by their doctrines.]

Wilson & Family's Cult & Cash Machine (aka the Christ Church Cult) Motto:

You must tolerate us since we do not tolerate anyone else.


The religious persecution defense by the cult is not only irrelevant to the issues but clearly a sham.  Wilson's bible, The Art of War, is at work here, not the Gospels of Christ (see below).

God commands the judge to evaluate the crime rather than the criminal. If the crime is one for which God requires death, then death must be the punishment. Your eye shall not pity. Neither is the repentance of the accused relevant to the imposition of the sentence. 

"Thus, the Bible teaches that pity is not an option where God has decided the matter. The [civil] magistrate, God's minister, is to faithfully execute justice according to God's standard, not man's... This means that we must return to an obedience which confines pity within the bounds which God has established for us."



Let's see:

Murder (by even a child), kidnapping, sorcery, bestiality, adultery, homosexuality, cursing one's parents, heresy, etc. are to be punished by death (by stoning).
