C.  Receipt of P&Z Preliminary Plat Recommendation for Meadowbrook 2nd
Addition - Andrew Ackerman
Planning and Zoning Commission recommended approval of a preliminary
plat for MeadowBrook 2nd Addition on July 27th, 2005.  Council's
acknowledgement of receipt of this recommendation will allow staff to
publish a hearing notice for a Council hearing on the application which
is proposed for September 6, 2005.
 
ACTION:   Receive recommendation.
 
2.      Discussion of Minutes for City Meetings - Gary J. Riedner 
Over the past several years, minutes and minute taking have come under
increasing scrutiny.  The method as well as contents and staff time
necessary to take effective minutes have become an issue.  Staff would
like to have a discussion on Council preference and methods.      
 
ACTION:  Direct staff as deemed appropriate.

A.     Approval of Minutes July 25, 2005 - Stephanie Kalasz
 
B.  Receipt of P&Z Preliminary Plat Recommendation for Meadowbrook 2nd
Addition - Andrew Ackerman
Planning and Zoning Commission recommended approval of a preliminary
plat for MeadowBrook 2nd Addition on July 27th, 2005.  Council's
acknowledgement of receipt of this recommendation will allow staff to
publish a hearing notice for a Council hearing on the application which
is proposed for September 6, 2005.
 
      ACTION:   Receive recommendation.
 
2.   Approval of Disbursement Report for July 2005 - Don Palmer
 
3.   Alturas Pathway ROW Vacation - Les MacDonald
As part of the platting of the first Alturas Business Park, a 26 foot
wide public right of way was dedicated for use as a parkway and path
along the north boundary of the plat.  This was originally intended to
be location of the Paradise Path system.  Subsequently, the City of
Moscow acquired the abandoned railroad right of way for use for the path
and the 26' right of way has not been utilized by the City other than
for landscaping.  The owners of the properties located along the north
boundary of the Alturas Business Park have requested that the right of
way be vacated.  In the event that the city chooses to vacate this right
of way it would revert to the lots located to the south.  Specifically,
these are Lots 1-3 Block 1 and Lot 1 Block 2 of the Alturas Business
Park.  Notice of the proposed vacation has been sent to all the
franchise utilities as well as the City water and sewer departments.
The franchise utilities have indicated that they have facilities within
the existing right of way.  In order for their facilities to remain an
easement shall be required.  
 
ACTION:  Recommend approval or denial of the proposed vacation of this
portion of public right of way.
 
4.      2006 Overlay Consultant Contract - Les MacDonald
The Public Works Department obtained a federal-aid grant for $600,000 to
construct overlays / street rehabilitation on several off-system streets
in Moscow. These funds are programmed for FY2006 construction. $500,000
of the grant is for construction and $100,000 is for engineering and
project development. Due to the limited amount of time remaining for
development and design, staff determined that seeking outside resources
would be necessary to meet timelines. Riedesel and Associates, Inc, from
Lewiston was chosen from a State approved list to provide the
engineering services, and came recommended by the Local Highway
Technical Assistance Council (LHTAC).  Staff has negotiated estimated
man hours and costs with the consultant to fall within available funding
limits. A professional services agreement for $92,000 is prepared,
attached and ready for signatures by both parties to initiate the work.
A Resolution and State and Local Agreement for this project were
approved by Council on March 7, 2005.
 
ACTION:  Recommend approval of the Overlay Consultant Contract or take
such other action deemed appropriate.
 
5.      Joseph Bridge Consultant Contract - Les MacDonald
The $500,000 Joseph Street Bridge replacement project (80% Federal, 20%
Local) is being scheduled for construction the summer of 2006.    Staff
has been unable to complete the design as had originally been planned.
In order to accommodate the compressed time schedule necessary to keep
the project on track for 2006 construction, Taylor Engineering of
Pullman was selected from an Idaho Transportation Department 'Approved
Consultant Listing' to conduct the design.  Hodge and Associates and
Entranco were two other consultants considered.  The selection of the
engineer and the negotiation of the contract were performed under the
direction of the Local Highway Technical Assistance Council (LHTAC),
sponsor of the federal assistance program.  The amount of the contract
is $80,647.69.
 
ACTION:  Recommend approval of the Joseph Street Bridge Consultant
Contract or take such other action deemed appropriate.
 
6.      UI Annexation - Joel Plaskon 
The University of Idaho has requested annexation on approximately 43
acres of land located north of the Palouse Mall.  The Planning and
Zoning Commission conducted a public hearing and recommended approval of
the annexation on May 11, 2005.  The Council considered the Ordinance on
first reading June 6, 2005 and considered the Ordinance on second
reading June 20, 2005.  The third reading of the Ordinance will be
considered by the Council on August 15, 2005.
 
ACTION:  Recommend that Council approve third reading of ordinance to
annex subject land, or that they reject it, or that they take other
action as deemed appropriate.
 
7.   Comp Plan Amendment - Joel Plaskon
The University of Idaho has requested a Comprehensive Plan Map amendment
for approximately 66 acres of land located north of the Palouse Mall
from Agricultural (A) and High Density Residential (HR) to Extensive
Commercial (EC).  The Planning and Zoning Commission conducted a public
hearing and recommended approval of the annexation and Comprehensive
Plan Map amendment request.  The Council decided at a public hearing on
June 6, 2005 to reopen the public hearing on the Comprehensive Plan Map
amendment request after the annexation process had been completed.  The
third reading of the Ordinance to annex the subject land will be
considered by the Council on August 15, 2005 which will be immediately
followed by the public hearing on the Comprehensive Plan Map amendment
request.
 
ACTION:  None needed.
