Remember way, way, way back in 2001, when we refused to sign the International Criminal Court treaty? This is /exactly/ what the International Criminal Court is for: prosecution of war crimes. If we had done the right thing then and signed the treaty, we could do the right thing now: turn our soldiers over to be tried for war crimes.
And if we ever find out that it goes higher on the chain of command -- say, to Donald Rumsfeld -- /they/ should be prosecuted for war crimes, too. You can't simply get away with this sort of thing because you're an American.
