As it happens, Donovan and I were both right, regarding the US =
Constitutional Amendment at issue in the Nevada case that was argued =
this week in the US Supreme Court, Hiibel v. Sixth Judicial District =
Court of Nevada, No. 03-5554.
The question presented is:
"Do Fourth and Fifth Amendments bar state from compelling people to =
identify themselves during police investigation when someone has been =
seized upon less than probable cause?"
Both the Fourth Amendment right against unreasonable searches and =
seizures AND the Fifth Amendment protection against compelled =
self-incrimination are at issue.
