The Moscow Mayor and City Council welcome you to tonight's meeting. We
appreciate and encourage public participation. For certain regular
agenda items, an opportunity for public comment may be provided after
the staff report. However, the formality of procedures varies with the
purpose and subject of the agenda item; therefore, the Mayor may
exercise discretion in deciding when to allow public comment during the
course of the proceedings and limitations will be placed on the time
allowed for comments. If you plan to address the Council, you will find
a list of "Tips for Addressing the Council" on the table outside the

PLEDGE OF ALLEGIANCE
1. Consent Agenda: Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later. Approval by roll call vote.
A. Approval of Minutes of November 15, 2004 - Stephanie Kalasz
2. Status Report on 1912 Mayor's Use Committee - Joanne Reece
ACTION: Accept report.
3. Appeal on St. Mary's CUP and Variances - Andrew Ackerman
An application made for the expansion of St. Mary's Catholic School that
included the granting of four Variances and a Conditional Use Permit by
the Board of Adjustment on September 21, 2004 is now being appealed by
concerned neighbors. The application was initially heard by the Board of
Adjustment on April 1, 2004, and tabled due for consideration of
suggested design revisions and potential historical impacts. The design
was revised to address the potential adverse impacts and concentrate
expansion activities exclusively on the St. Mary's property. Due to the
size and type of the proposed expansion relative to the lot, the school
requested four Variances from the Zoning Code: 1. to exceed allowable
height; 2. deviation from Type A buffer yard requirements; 3.
encroachment into the required setback; and 4. reduction in the number
of off-street parking required. The Board granted the Conditional Use
Permit and four Variances with the provision that the Board would
revisit the CUP one year from the date of approval to assess parking
related impacts as a result of the expansion.
ACTION: Affirm, reverse or remand the matter in whole or in part.
4. Rezone & Preliminary Plat 1025 N. Mountain View Road
(Slonaker) - Joel Plaskon
The Council conducted a public hearing on November 15, 2004 to rezone
1025 N. Mountain View Road from Suburban Residential (SR) Zoning
District to Low Density Single Family Residential (R-1) Zoning District.
The motion to pass the related Ordinance (under suspension of the rules
requiring three complete and separate readings and that it be read by
title only) was not valid because the vote was three to two. Such a
motion requires a vote of one half plus one members of the full Council.
Consequently, the passage of the preliminary plat was not valid because
the property had not been properly rezoned. Staff is returning the
rezoning ordinance to the Council for consideration on second reading
and if the rezone is properly passed under suspension of the rules,
staff will also request a subsequent vote to approve the preliminary
plat. These subsequent actions are based upon the record made at the
public hearing on November 15, 2004 and no additional public testimony
will be taken.
ACTION: Approve the Ordinance for rezone under suspension
of the rules requiring three complete and separate readings and that it
be read by title only; or approve Ordinance on second reading; or take
such other action deemed appropriate. If Ordinance is approved, approve
or deny preliminary plat or take such other action deemed appropriate.
5. Lot Line Adjustment Proposal by Mark & Joanne Taylor - Andrew
Ackerman
Mark and Joanne Taylor own both lots involved in the proposed lot
adjustment, currently addressed as 714 Mabelle St. and 715 E. Lewis St.
The property is located in the Medium Density Residential (R-3) Zoning
District. The lot adjustment proposes to subtract approximately 4,000
sq. ft. from the eastern side of the existing Lewis parcel and add it to
the approximately 10,200 sq. ft. Mabelle St. parcel. This would make the
larger Mabelle parcel a double fronting parcel. The lot adjustment meets
all code requirements for minimum lot size and access. The side yard
setback from the existing Lewis St. residence and the proposed new lot
line would meet the minimum requirement of five (5) feet and the side
yard setback from the garage on Lewis St. and the new lot line would
also meet the five (5) foot minimum. Thus, the adjustment would not
further any non-conformities related to setbacks from property lines to
existing buildings. Reviewed by the Public Works/Finance Committee on
November 22, 2004.
ACTION: Approve the lot division, with or without conditions; deny the
lot division; or take such other action deemed appropriate
6. 2004 Report on Hamilton-Lowe Aquatics Center - Dwight Curtis
After the conclusion of each summer pool season, the parks and
recreation department staff presents a summary of the seasons highlights
to the City Council and Mayor. This report will cover expenses,
revenues, attendance, data analysis, staffing and assorted issues from
the 2004 season at the Hamilton-Lowe Aquatics Center.
ACTION: Accept report.
