A question for attornies subscribed to this list (subscribers with law
degrees):

Evidence:

1. DNA genetically identical to a father and his two 18-year old children
extracted from the crime scene (that could only have been left there by the
person who committed the crime)

2. An eye-witness description of a single perpetrator that is identical to
the father and his two children.

2. Sworn testimony reflecting that the father had been training his
children to commit crimes identical to the one being charged.

Question: Could (in the absence of a confession) the father and his two
children be charged with conspiracy? What are the rules of evidence
concerning such a scenario?

Just curious,
