[Liability Insurance] Insurance & Surety Committee - New Decision re Workers Compensation Immunity

Everyone:

Attached is The State of Florida v. Florida Workers' Advocates, et al., (Fla. 3rd DCA, June 24, 2015), which reversed the trial court's decision that held section 440.11, Florida Statutes, the exclusive remedy under the workers' compensation statute, unconstitutional.  The Third District did not address the merits of unconstitutionality, but rather reversed on mootness and standing grounds.  The unconstitutionality of the exclusive remedy of the workers' compensation statute will certainly be raised again in a future suit.
