                You’ll see below and attached an email from Debbie Goodall forwarding a request from the Business Law Section for comments by the RPPTL section on the proposed Computer Abuse and Data Recovery Act. Debbie’s email notes the RPPTL committees in whose jurisdiction this most likely falls, but I wanted to get your thoughts as to whether Insurance and Surety may want a voice with the increasing awareness of cyber insurance and the recent Florida legislation imposing notice requirements and potential liability for data breaches. Bill, I was originally thinking Eric Virgil for digital assets (and we still can) but on closer inspection, it really seems to be more relating to protecting owners of computers so maybe it is more a Member Communications/Technology or Ethics/Professionalism as it relates to law firms.  I know Mike and Michael were already copied on this separately so perhaps they have determined the best fit.  Copying Drew as well in case other real estate interests may need to be contacted.

The Business Law Section will be seeking the permission of the Big Bar to pass the Computer Abuse and Data Recovery Act (CADRA).  The purpose and the policy of the Act to (a) protect owners, operators and lessees of computers used in the operation of a business from harm or losses caused by unauthorized access to protected computers and (b) to protect owners of information stored in protected computers used in the operation of a business from harm or losses caused by unauthorized access to protected computers.

We wanted to notify you as Chair and Chair-elect of the RPPTLs of our intent to pursue this legislation.  Please let me know if you have any concerns or questions and we will be happy to set up a conference call to discuss the Act in more detail.
