I am not the legal scholar that you are, however,  I am very practical. I advise my clients that roofers are less expensive than lawyers. I send a letter to the landlord about the problem and advise that if it is not fixed within so  many days that your client will have a roofer attend to the repairs to stop the leaking and  mitigate your client's damages.  I do not advise my client to deduct this expense from the rent.  It stops the legal and avoids  legal expenses.

Good morning all,
I am representing a commercial tenant in a shopping center that has been trying to get its landlord to fix roof leaks going on two years now. The lease is a typical commercial lease and does not give tenant self-help rights. Any suggestions as to possible remedies other than rent abatement?
