Dear committee members:

In response to the emerging issues surrounding COVID-19, we will be conducting two 45-minute conference calls on Friday, 3/27/2020, with the first being held at 11:00 am EST to discuss commercial leasing issues and the second to be held at 12:00pm EST to discuss residential leasing issues.

Because we did not get anyone to volunteer to lead these topics, I'm not sure how we best handle the discussion to keep it orderly, other than in the following order based on the comments I have received:


1.       What can a landlord do when an Association either is not there to give an approval application or refuses to process them.

2.       Landlord Repairs and Maintenance during COVID 19

3.       Removal of tenant's property by a moving company where the company is denied access to enter and move the tenant out.

4.       Closed communities that are trying to continue application reviews and approvals but with different processes.

5.       Evictions and the ramifications of clerk and court closures.

6.       Discussion whether attorney generally agree on common issues: days when clerk's office closed or closed to public will be "legal holidays" for nonpayment notices? For the five-day answer/deposit period? For serving nonpayment notice?  For serving the summons?

7.       County by county tracking.

8.       Landlord moratoriums on evictions and/or writs.  Clients appear to be opting to either wait till Clerk's office re-opens/re-opens to public and serve new nonpayment notices; or proceed to file eviction with valid March notices.  In the later cases, any issues with judges proceeding with defaults on a two or maybe three month old nonpayment notice?

I will moderate the call and in order to keep the call timely and orderly, I am requesting that any questions be sent via listserv to be read to the group and addressed in the order received at the end of the call.
