Our Firm handles residential owner disputes with Associations, in particular leasing regulation disputes. This includes negotiations, Statutory Records Inspection Requests, Pre-suit Mediation and litigation. We are perpetually dealing with associations who do whatever is in their power to keep owners from renting.
One of the more onerous rules/bylaws some have is a limitation on how many leases in one year. Fine, this is understandable, but we are seeing cases where a tenant is approved, lease signed, moves in, breaks the lease 3 month’s later or, is evicted, and NOW the owner cannot rent again until the year is up.
Any attorneys out there willing to take on any cases against associations? This seems to be an unreasonable restriction on the right an owner has to rent if indeed yearly rentals are allowed.
Ideas? Any takers? I have many other situations where owners need to go after their own association. Of course the big association representing firms want nothing to do with this.
I also have referrals for smaller associations who need basic work and do not want to pay the $450 and hour or big retainers the big guys charge. Our firm does nothing but LL/Ten so we cannot assist.
