Group:
Does anyone have any information on FCRA cases against a landlord or against a debt collector (furnisher) that reports charges to CRA when the landlord didn't send a notice of intent to withhold security deposit (which the tenant did not have 15 days to dispute), then send the debt to the collection agent based on the move out sheet (which is usually attached to the intent to withhold letter/notice).
Is there an argument that there cannot be a debt until the Notice of Intent to Withhold Security Deposit is received by the tenant and the tenant fails to object?
