Agreed.  The lien would have to be levied upon for the property to be other than tenant’s.

I would think that the property is still owned by the Tenant until the Landlord obtains and executes a writ of execution. While there may be a lien, it does not at that point belong to the landlord.

Members:  I am looking for any opinion on the following issue:

Under Florida law, whether a commercial tenant, after an eviction action has been instituted, who removes personal property from the premises when rent is past due, can be found civilly or criminally liable for conversion or civil theft?
