Hello All,

 

When evicting a tenant who is known to be in the military, the way we read
the law is that an ad litem attorney has to get into the picture and the
cost is borne by the Plaintiff. It seems odd as the Plaintiff is finding an
attorney and paying them to be the attorney for the military Defendant.

 

We have had a couple occasions where we had to do this already and were
wondering how anyone else is dealing with it or who knows attorneys in
certain counties who will act as the ad litem attorney for a low fee. The ad
litem attorney's job is to attempt to locate the tenant and if there is a
meritorious defense, make it.
