Folks,
On our last call, I mentioned that we were putting together a lien law task force to address at least two issues that came up during the recent legislative session on which no consensus was reached but for which we decided to form a task force to begin developing a bill for the next legislative session. Without getting into the weeds, it involved using subcontractor payment bonds as lien transfer bonds and clarifying the definition of “final furnishing” for purposes of specially fabricated materials in the context of a contract termination.
I have three volunteers so far for this task force. I am not envisioning a large group, but we can certainly expand beyond the three volunteers who have spoken up so far. If you are interested in joining and have not sent me an email, please do so by next Tuesday, Feb. 18 so that I can finalize the membership, appoint a chair and get the committee started on this important work.
