The terms of 190.044 by exempting a CDD from levy and sale by virtue of an execution operate to remove a CDD from the statutory definition of an “owner” under ch. 713 (much as municipalities and counties are removed by the same concept).  Without an “owner”, there are no lien rights to be acquired by a lienor.

713.01(23) - “Owner” means a person who is the owner of any legal or equitable interest in real property, which interest can be sold by legal process, and who enters into a contract for the improvement of the real property. The term includes a condominium association pursuant to chapter 718 as to improvements made to association property or common elements. The term does not include any political subdivision, agency, or department of the state, a municipality, or other governmental entity.

Has anyone researched whether property of a community development district can be subject to a construction lien under Chapter 713, or whether it is exempt as government property?  Section 190.044, Fla. Stat. provides that district property is exempt “from levy and sale by virtue of an execution” that “no execution or other judicial process” can be had against district property, and that “nor shall any judgment against the district be a charge or lien on its property or revenues” but doesn’t speak directly to construction liens and I want to make sure I’m not missing something.
