[CLC-Discussion] Chapter 489 - Repairs to mobile homes

To amplify my earlier point, I had a client recently get a contractor cited for failing to pull permits for repairs made to a mobile home.  So at least in Duval County, they are considered governed by the building code and Chapter 489.  Also, there is the definition of real property in 713.01(26):

(26) “Real property” means the land that is improved and the improvements thereon, including fixtures, except any such property owned by the state or any county, municipality, school board, or governmental agency, commission, or political subdivision.

Granted, this is Chapter 713, not 489.  But 489 defines a contractor as one who “improve[s] any building or structure, including related improvements to real estate” (489.105(3)), which is very analogous.

Ok, this is very old (how 's that for a softball  invitation to wisecracking) information,  but when the Florida  legislature  passed  the comprehensive  mobile home statute in  the  last century,  that gave mobile  home park residents all kinds of rights, they made the rather remarkable  finding  that mobile homes are not  mobile.  I  think that if the contemplated work  would  require  a license if performed  on a conventional  house,  a license  is required  to perform  that work on a mobile  home.

I think it may depend on the extent to which the mobile home has become a “fixture.” For example, is it still sitting on its wheels, or is it on a foundation? Is it permanently connected to utilities? Could it be moved without damaging it or the property itself? Etc. Not sure though.
