[CLC-Discussion] Residential contractor warranty

To the best of my knowledge only condominiums (associations, owners &
developers) have statutory construction warranty rights in Florida (The
UCC also provides some warranties but these can be difficult to apply to
a construction setting).

Unless express, all other construction related warranties come from
common law. There was an article written in the Florida Bar Journal a
few years back that does a good job of giving a general overview of
Florida warranties in the construction setting ( let me know if the link
doesn't work and I can give you a cite).

Subject: [CLC-Discussion] Residential contractor warranty

Hello folks,

I have a relative who is a residential contractor. He made
reference to what he believed was a statutory requirement that
residential
builders provide a warranty of a minimum of one year to the owner. Most
of
my practice involves commercial payment issues (i.e. liens and surety
bond
claims). I reviewed Fl. Stat. ch 558 but did not see such a
requirement.
Is anyone aware of such a statute and, if so, could you provide a
citation?

Thank you very much.
