The CC & R’s were never recorded but are given to each homeowner when they purchase their property. Of course, one homeowner refuses to pay the very small annual HOA dues. Its like $90. In reading the statute, I did not find anything saying the CC & R’s need to be recorded. Am I wrong? The CC & R’s talk about filing liens for unpaid dues, but gives very little direction regarding foreclosure.
