The tenant did not vacate the premises by that date and still remains in occupancy and possession of the premises. <o:p></o:p></p><p class="MsoNormal"><o:p> </o:p></p><p class="MsoNormal">The CR2A specifically states that if Defendant fails to vacate the premises by the agreed upon date, the Landlord is entitled to an immediate Writ of Restitution directing that the premises be restored to the Landlord and Landlord may file a motion without notice to Defendant or Defendant’s counsel.<o:p></o:p></p><p class="MsoNormal"><o:p> </o:p></p><p class="MsoNormal">Question – would I simply file the motion for Writ of Restitution ex-parte since the CR2A specifically waives notice requirements to tenant and tenant’s counsel?
