<p>I've dealt with this a few times, both as an attorney and an
agent. It may vary depending on federal or state, but besides the
FMV of the property there may be other benefits, including moving
costs and possibly helping to fix up a replacement house that
needs some work. One a few decades ago they would even pay over
FMV if there was nothing else in the area that could be purchased
for FMV.</p>
<p>More recently the offer they were making on a client's property
was so good that we couldn't begin to provide any comps that would
have provided additional value. They were 10-20% over value. But
yes, we could have fought.</p>
<p>And yes I believe you can even end up in litigation. When I was
about 12 years old my parents had some property Bremerton wanted
to take, and they were trying to avoid service. I remember
running into the process server after a friend had an unfortunate
experience with a peat bog, and being covered from head to toe in
peat moss looked more like he had an unfortunate incident with a
septic tank.</p>
<p>(Septic tank comment added so that people feel they are getting
their $25 worth.)<br>
