 RCW 61.24 et seq. <b>prohibits a beneficiary from proceeding to foreclosure right away</b> and instead requires certain due diligence, meet and confer and mediation steps to be taken in certain cases. 
<b>I would argue that this is a statutory prohibition on commencement of an action</b> and thus should not count against the beneficiary if the borrower were to challenge on the SOL defense.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin-left:.5in"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D"><o:p> </o:p></span></p>
<p class="MsoNormal" style="margin-left:.5in"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D">Furthermore, the CFPB servicing rules, contained in 12 CFR 1024.41 similarly prohibit through federal rule the commencement of a foreclosure
 action by a beneficiary in certain circumstances.  Before getting a borrower’s hopes up that the SOL might help them get out of their debt, consider the huge efforts that were made at a state and federal level to provide loss mitigation to so many borrowers
 in our state (and across the country).  To come back and say that compliance with those efforts might prejudice the beneficiary from recovery on the debt, especially when the stakes are high and liability can be extreme for running the loss mitigation red
 lights put into effect is not likely to be supported by a court if you consider RCW 4.16.230.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D">But contrariwise, G. Karl Long pointed to
<u>Kirsch v. Cranberry Financial, LLC</u>, No. 69959-8-I (Dec. 23, 2013, unpublished), for the proposition that a filed and then dismissed
<u>judicial</u> foreclosure does not toll the S/L, and suggested that nonjudicial proceedings probably shouldn't be treated more favorably.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:#1F497D">And I think there is another case out there, published or unpublished, stating explicitly that nonjudicial proceedings do not toll the underlying S/L on the

<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri","sans-serif";color:windowtext">Gregory,  Tom Hause in our office is doing one of these right now.  No payments since December of 2007.  Note that the statute of limitations is tolled during
 any bankruptcy proceeding and during any active foreclosure.  In our case the debtor was in bankruptcy for 14 months and under an active notice of trustee’s sale 8 times. The sales were never held or the action was cancelled each time.  During those time periods
 the statute was tolled.  You need to pull the title history and look for trustee’s sales and also check with the client for any banko filings, even if they are dismissed.  If you want to refer it out, give Tom a call he may be willing to take on another SOL
