Because a deed must be acknowledged, the common law "equal dignity
rule" requires that a power of attorney be acknowledged in order to
empower the attorney-in-fact to execute a deed for the principal (as
I recall). And a title insurer will want the power of attorney
document to be a public record -- normally by recording it (which I
believe requires that it be acknowledged).<br>

But consider filing a petition under RCW 11.94.090(1) to "(e) Modify
the authority of an attorney-in-fact under a power of attorney;" to
expressly authorize the POA agent to sell the principal's home.
That procedure is continued, post 1/1/2017, in RCW
11.125.160(2)(e). If a court order expressly authorized the POA
agent to convey title, I would hope that a title insurer would be
satisfied with that court record.<br>

That one-time procedure appears a preferrable alternative to a
guardianship that would entail ongoing costs.<br>

knowledgeable than me. We are Attorney in Fact for
financial affairs for a person who is no longer capable of
executing documents. The Durable Power of Attorney was not
notarized. We have to sell the principal’s home. <o:p></o:p></p>

<p class="MsoNormal">My recollection is that a Durable Power of
Attorney, while currently valid even in absence of an
acknowledgement, needs to be acknowledged to properly
authorize the agent to transfer real property for the
principal because the principal’s signature would have to be
notarized to accomplish this act. If I am wrong about that,
please let me know.

filing for guardianship just to transfer the property. Ugh.
What I am wondering is, assuming I can go to court under RCW
11.94 and get a court order which says that I, as the attorney
in fact, have the authority to transfer the real property,
whether that would be sufficient to transfer and maintain a
proper chain of title.<o:p></o:p></p>
