Walchenbach Law

Potential client (PC) reports that a landlord got a default judgment against him for unpaid rent.

Basic facts:

- PC was named, along with his mother, as a tenant in residential lease
- PC was a minor, age 15, when lease was signed by landlord and the mother
- PC did not sign the lease
- Mother failed to pay rent
- Landlord brought unlawful detainer action, naming mother and child as defendants, PC was still a minor but not identified as a minor in the complaint
- Court entered default judgment, including judgment for $7K in fees against mother and PC

- PC is now an adult
- PC applied for, and was denied, a rental apartment of his own.
- the credit/rental report listed default and judgment as reasons for rejection

- Time is of the essence because PC needs a place to live.

My thoughts:

Have PC write a letter to the landlord and the law firm that represented landlord, demanding that the default and judgment against PC be vacated within 30 days. And put them both on notice that if they don’t, then PC will hire an attorney, bring a motion to vacate, and seek fees.

Your thoughts?

Thank you for any insights you may share.
