Consider a modification of the following: "Anti-Merger. Declarant states that the unity of right, title, and interest to Lot 1 and Lot 2 shall not affect this Declaration and the same shall run with the land until such time as this Declaration is terminated according to the terms herein. As stated, this Declaration is expressly made to establish the stated restrictive covenants and is intended to apply to Lot 1 and Lot 2 without operation of merger, even though Declarant currently owns both lots."

That in the declaration you would make a recitation that the declare an owns both lots and that the purpose of the declaration is for the benefit of the one lot and that. If there is any violation other restriction that the owner of that lot has the right to seek equitable relief and or damages as well as attorneys fees for breach of the covenant and furthermore that it cannot be modified or amended except in writing signed by the owners of both parcels the right to live in the house

Client wants to sell their next door lot and record a Declaration prohibiting STRs upon that next door lot before it sells. After the sale what's to keep the new owner from recording a revocation of that Declaration and then renting to STRs?
