Colleagues,
Client in E. Washington granted a First Right of Refusal to purchase their farmland to the neighbor, recorded with the County. Client wants to give his granddaughter the right to purchase the property from his estate when he passes.
Questions: (1) would the recorded First Right of Refusal die with the client (automatically terminate upon his death)? (2) if client wanted to rescind the recorded First Right of Refusal, would he need to neighbor's signature on the rescinding document?
If it makes any difference, client received no consideration in exchange for the First Right of Refusal
I appreciate any advice / direction / perspective
Thanks!
