I have had similar situations like that in the past and have written and nasty ground letter outlining the incidents complained of and threatening action based on the same causes of action as set forth in your e-mail and after receiving the letter by a certified and regular mail the activity ceased and so it was not necessary to take any further action thank you so much but I think the nuisance statute is a good basis for A cause of action if the activities continue on as well as the intentional infliction of emotional harm cause of action

Good morning Listmates.  I am sure this is not a case of first impression so I hope some of you will have already crossed this bridge.   Short story is clients are an elderly couple that have a new neighbor that blasts Rap music day and night as well as runs equipment and machinery into the wee hours.  Noise exceeds county ordinances by 70-80 decibels.  Police have made them shut down multiple times but it comes right back and at increased levels.  Code enforcement is not acting.  We are filing a civil suit against the owner.  Nuisance, intentional or negligent infliction of emotional harm, violation  of laws designed to protect the client.    Anyone have success in a case like this that would be willing to share  causes of action, or experiences?    Thanks in advance.    Craig
