First place to look are the bylaws and rules of the cemetery. They will control.

Listmates, Even after 40 years, never a day goes by that I don’t get asked a question I have never encountered or thought of. Today’s Friday question involves a burial plot. Person A buys a burial plot and buried someone in it. Family feud erupts and Person B now wants title to the plot with the deceased in it. Is this treated like any other real estate dispute? Does the treatment of the plot somehow change once it is “ occupied”? Is there an excise tax on transfers? A brief look at the statutes doesn’t give me much guidance, but perhaps the lack of any reference may in itself be the answer. But, it is Friday so I look to the brain trust for an easy answer. Thanks, Craig
