[WSBARP] 2-year Bar Cr. Claim Bar applicable to Medicaid Lien

Follow up to my original question.

Since it is in the PR's discretion whether to elect to comply with the claims statute, and reading RCW 11.40.020 again, which states "If notice is given: (d) the PR shall also mail a copy of the notice . . . to OFR"

I'm thinking that would imply that if the PR does not elect to comply with the claims statute, he\she is not required to give notice to OFR.  Has anyone used that argument and been successful?

Has anyone dealt with a Medicaid lien in a situation where PR never notifies OFR of the probate, home (only asset of the estate) sells - no lien filed against home, 2-years have passed, and now PR wants to close probate.  What position might OFR take if they never received a notice of the probate.
