[WSBARP] Excise Tax Question

I’ve got a boundary dispute which the parties would like to resolve shy of initiating suit through an easement.  Is excise tax due on that easement or do I need to file the suit and get a judgment?  Has been a while since both parties agreed to an easement pre-litigation (which is good seems to me).
