A slightly contrary opinion - while not flagged by the Assessor, the
recording is still legally sufficient. When I have encountered this and
waded in to help in such instances, it has always been confirmed to me by
title that they can search and find the recorded document even though not
cross referenced with the parcel number, and so generally a re-record is not
required.  

 

It would likely depend on the specifics and I'm 110% for corrections as they
seem warranted but on this one, I would ask title if they can find it and if
they agree if confirms all vested in the survivor upon recording.

Given the facts as they have unfolded, I would take the following steps:

1.	Prepare for surviving spouse's signature, and Record, a Community
Property Lack of Probate Affidavit (CP-LOPA) with a coversheet identifying
the property and the recording number(s) for the CPA and DC.
2.	Complete and mail to county their "Name and Address Change Request"
form.

Listmates:

 

Spouse died.  Attorney for the surviving spouse recorded the Community
Property Agreement with the death certificate.  No coversheet with the
identifying information for the couples home.  Deceased Spouse's name is
still on title.  Do I simply rerecord the CPA with the coversheet?  Is there
an easier way to get the county to recognize it? I could call but is that
sufficient for the record of title?
