If the condo was created prior to 07/01/18 then 64.34 applies except for those provisions of 64.90 that apply to all CIC but  still must give POS

Subject: [WSBARP] Old condo- first sale

Listmates,  I am pretty sure I know the answer to this but thought I would float it out there in case I missed anything.   Small condo conversion project formed in late 2007 but due to market issues the declarant decided to just sit on them and rent them out. If they start to sell them now ( 16 years later) I think they are still subject to the Public Offering Statement and all the transition rules etc because it is being sold by the declarant.  Am I correct on this?  Thanks in advance.
