Would CR60(b) be applicable in this scenario?  CR 60(b)(3) would appear to apply to a newly discovered Will, but it only gives a party one year to file. If there was fraudulent contact by the PR in concealing a Will, then maybe CR60(b)(4) would give more time?

I hadn’t though of it that way but I bet that’s the practical statute of limitations on discovery of a Will, based on the intestate heirs’ possession and control of the decedent’s property. Three years for personal property under RCW 4.16.080(2)<https://app.leg.wa.gov/RCW/default.aspx?cite=4.16.080>, and seven or ten years for real property under RCW 7.28.070 and .080<https://app.leg.wa.gov/RCW/default.aspx?cite=7.28&full=true#7.28.070> or RCW 4.16.020(1)<https://app.leg.wa.gov/RCW/default.aspx?cite=4.16.020>. If those limits pass, the intestate heir would have a possession-based and time-based defense to any claim of ownership by the beneficiaries under the will, and maybe even against a duly appointed Executor under a late-discovered Will.



I don’t know of any case law on that issue though. Just speculating.

Don’t see one. I suppose at some point the doctrine of impossibility might come into play, or adverse possession, or any number of other common law doctrines to protect long-held expectations and reliance.

Revocation of letters by discovery of will.

If after letters of administration are granted a will of the deceased be found and probate thereof be granted, the letters shall be revoked and letters testamentary or of administration with the will annexed, shall be granted.

Is there a time limit for contesting an intestate probate?  Assume a lost will, children commence probate as intestate, PR appointed and work partly done,  or completed, then a child finds what appears to be a valid will; what then?
