[WSBARP] First Right of Refusal & Tax Sale

Property taxes are always first lien, so I think a tax sale would definitely eliminate a right of first refusal…..
I would talk with the people at the assessor’s office and find out if the client’s interest as holder of a right of first refusal is sufficient to allow them to pull the property out of the sale by paying the taxes.

Subject: [WSBARP] First Right of Refusal & Tax Sale

Can anyone tell me whether a tax sale would extinguish a recorded first right of refusal on real property? If so, is there anything that can be done to preclude it? I understand that tax sales do not go through title.

Thank you in advance!
