[WSBARP] Issues with King County Recording

Brent, More fodder for your position. Mom gives QCD to daughter along with excise tax aff. They did not know they needed a supplemental.  Mom dies. Daughter is PR and executes supplemental as PR. Rejected because some hero in excise decided a PR was the same thing as a POA and it expired on Mom's death. Huh???  I went through the formal DOR hoops asking them to issue a directive that a PR can sign on behalf of the decedent. Several months pass with follow ups before I get the response from DOR that this is a legal question and they don't answer legal questions (since when is a tax opinion NOT a legal question).  After advising them this was not an acceptable answer they moved it up the food chain.  Months go by and despite follow ups no response.   Finally after significant pushing I am told that the person handling this is no longer with the department. ( Be sure and confirm you got your fries next time through the drive through).  Two days later we get an " Of course you are right" opinion.   Expecting the hero at Snohomish County to feel above DOR direction one of our attorneys hand carried it to Excise with all of the accompanying documentation and not surprisingly was told " you can't do it this way". Gwendolyn then says "that sounds like you are making a legal determination." At which point the supervisor just said give her what she wants.   The point is they are out of control with no accountability, practicing law and making everyone's life miserable.  I hope you can get someone in authority to curb this insane power County excise seems to wield with no consequences.   This little mess delayed my client's vesting title for almost a year and cost thousands of dollars in time.

I had one sent through Simplifile late last year that took 7-8 attempts to record.  It was something fairly simple, but every time there would be a different person who would review the document I believe, and come up with a completely different reasoning for denial.

Brent, thank you for doing this.  Here is another one my paralegal ran into:



"The exemption description on the REETA was too long to fit into their box so I just wrote "see attached" and added the entire description to the attachment.  It was rejected because we didn't include a partial reason before writing "see attached". "



I'm hoping you can also find out if the recording folks even understand the rising frustration with them.

Apologies for the duplicate post from RP and PT sides but I am looking for feedback as it relates to property transfers in King County.



Many of us have had interesting encounters with the King County Recorders office.  Most recently, I was transferring four pieces of property and three of the four were accepted and recorded and the fourth rejected. The Deed and REETAs were identical for everything except the parcel number, property value and legal description. Grantor, Grantee, reason for transfer - all the same.



Reason for rejection - the Grantor in Box 1 did not match the Deed exactly.



So it was ok for 3 of them but #4 - that was just unacceptable.  If you have had a recent story (that you have not shared with me) regarding frustrations with the Recorder's office, please share. I am compiling these to be share with the the Director and Executive's office.
