[WSBARP] Affidavit of Lack of Probate

This was a purchase; the only other heir is the couple’s daughter, who in the end will get it.

Without more information as to heirs, I would presume so.  Even if it were the case that he inherited the property, at the point where he used marital funds to "purchase" the property, I would suspect transmutation into marital property.

H & W married in 1975.  In 1999, H purchases the family home taking title in his name alone.  The deed on includes his name and it does not say “as his separate property.”  H dies over 2 years ago.  No Will, no probate has been done.  Would a title company (property in Jefferson County) insure title in W if she records an affidavit of lack of probate?
