[WSBARP] Affidavit of Lack of Probate

Listmates:

 

H & W married in 1975.  In 1999, H purchases the family home taking title in
his name alone.  The deed on includes his name and it does not say "as his
separate property."  H dies over 2 years ago.  No Will, no probate has been
done.  Would a title company (property in Jefferson County) insure title in
W if she records an affidavit of lack of probate?
